  • They obtained without reasonable cause, which is a seperate matter you can sue them for later

    You need that in writing, confirimng that was true AS OF the date in question, or before. Not any help if it is after the date!

    You want as much as possible proving you were NOT the driver, and as a private individual have no liability under law of agency either. So if you cna get other work records, such as badge sign in and out times, that would help.
  • They advised that they do have a company who are in charge of the parking enforcements but it is not and never has been VCS, i am still awaiting his email though but will make sure I get this all in writing.

    I am the director of a small company within an office so we do not have signing in and out etc, I have 3 members of staff however who can all corroborate i was working that day between the states times also, however there is only one time on the charge notice? and not a period ..

    Assuming the time on the PCN is the time you entered the car park or commenced parking, then, if one or more of your witnesses can state that you were in the office AT THAT TIME, that should do it!

  • Possibly! I have requested the name of the company they use, however I now have written confirmation that VCS have never been contracted by the management company.

    Would it be worth writing to VCS to give them a chance to cancel/settle the claim or shall I leave it for evidence?
  • Update it has now been confirmed that the management company/landowner do not and have never had an enforcement company contracted to patrol the contravention site where the ticket was given!

    Some courts are better than others at dealing well v VCS, so which court is it?

    Sorry for the delayed reply, Yes! Hopefully it will not even get to the court stage once they have seen the evidence submitted!

    The hearing is in Cambridge I believe

    Well this morning I have recieved a letter of discontinuance!! Very relieved, is now a good opportunity to put in a claim for costs??
