    Basically you would need to sit it out until the LL applies to court for possession and then after that a bailiff for eviction date.

    Could take them quite a while and almost certainly jeopodise their sale unless the buyers are happy to complete without vacant possession and with sitting tenants (unlikely) or wait it out as well until you are evicted.

    Wow well thanks for much food for thought. I do not wish to inconvenience anyone or cause distress or wait to be evicted but I still cannot believe that a contract I signed is basically useless.

    This is the law; it may be an inconvenience, but it's no different to returning a faulty product to a shop.


    And you can still leave before 'being evicted'.


    Please be aware that bailiffs literally tell people what day and time they're coming. It's then just a case of handing keys over and off you go.

    It's also worth mentioning that while all the above is true the landlord, assuming they win will generally get court costs award to them. So while you can remain in the property until you're literally dragged out by the bailiffs if you wish it will cost you, assuming you can afford to pay. However the landlord can only take it out of your deposit if the contract explicitly specifies this.

    They couldn't however charge you for the costs of any sale falling through.

    It is absolutely not my intention to have to be evicted or to cause problems but the agent and owner seems to think its been ok to dismiss my concerns about the end date as unimportant. I want to stay until the 26th is those extra 19 days will be important when living in a caravan in January.

    If they won't agree to your request then your choices are to either leave or play hard ball as suggested by Comms69. They can't physically remove you and the extra few weeks is no where near enough time for a court case to go through.

    Did you actually read my post?
    However, assuming the above, if notice was (properly?) served on you with a (valid?) S21 Notice on 7th November, then it should expire either 2 calender months later on 6th January or 2 tenancy periods later on 26th Jan (depending on precise wording of the clause)


    Note that when the S21 expires the tenancy does not end and you still do not have to leave untill a court orders you to.
    And did you read the link?
    * Ending/renewing an AST: what happens when a fixed term ends? How can a LL or tenant end a tenancy? What is a periodic tenancy?


    If so, why the surprise?
    And if not, why not?
