Parking Eye - Parking Charge Notice Reminder

I have read through a lot of the posts and the sticky threads but seems all too much for me or slightly confusing.

The keeper received a parking charge notice reminder on the 20/10/2018. (the driver didn't receive the first letter apparently but that's here nor there at the moment).

Date of Event - *******

Entry time: *****

Exit Time: ******

The driver was over by 16 minutes. In the process of all this the driver had to drive around look for parking spot, had two toddlers with them and the machine was not working.

On the way back the driver had to get the two toddlers in (one who wasn’t really well which took a bit of time getting in the car) and again machine was not working and not accepting their coins. (the driver has two pics of machine but don’t really say it’s not working).

Ironically enough the keeper has until today to appeal; the driver Will appeal anyways today to see what they say and go from there.

Can anyone give any info, insight or advice to this please?
Thanks

Edit your post to remove information about who did what. Only ever refer to The Driver and The Keeper, who are two different people. ;)

Do this before you do anything else as the driver's identity can be determined from your post. I suggest you should delete the times you have quoted as well.

Is the year you have quoted correct? Can you really remember who was driving in 2010?

Send the initial appeal from The Keeper, using the template from the NEWBIES thread exactly as it is.

I thought so. You need to appeal as advised, then start reading up on how to win at PoPLA.

The Keeper received the reminder, not The Driver.

The Keeper needs to appeal today, NOT The Driver.

Please edit your post to correct this.

Print or copy the acronyms from post 5 of the NEWBIES. For PoPLA you will need post 3, but you must get the initial appeal in now.

When you say you received a reminder, was this within 14 days of the alleged event? That would be unusual if it is true.

You get 28 days to appeal and wouldn't normally get anything after the NTK has been received until after 28 days have passed.

What does it actually say on the letter you have received?

Done and I still cant seem to find the 'initial appeal from The Keeper', template from the NEWBIES? Can you show me exactly where it is?

exactly 14 days of alleged event.

Appeal is in #1 of the FAQ

    You cannot miss it!
  • without sounding rather like an idiot; is it the 'TEMPLATE ''ONE SIZE FITS ALL'' FIRST APPEAL THAT DOESN'T SAY WHO WAS DRIVING'?

exactly 14 days of alleged event.

Post 1 of the NEWBIES has an appeal template in blue. It is the only template in post 1.

So what does the letter say? Is it the NTK with ANPR pictures, or does it say the word "reminder"?
I think it is the NTK but please confirm what it says, as if it has arrived within 14 days starting the day after the alleged event, it is more likely to be the NTK, not a reminder.

No it says at the top: Parking Charge Notice reminder

It doesn't say NTK on there anywhere and has the ANPR pics on there

    Re PCN number:

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement. There will be no admissions as to who was driving and no assumptions can be drawn.

Since your PCN is a vague template, I require all photos taken, a clear image of the signage and an explanation of the allegation (e.g. if you have identified a wrong VRN input at a machine, say so, and explain why your Data Protection Officer has not simply rectified it, rather than trying to punish a driver for a matter where there is nothing to deter).

I will be making a formal complaint about your predatory conduct to your client landowner and to my MP, appraising all parties of the debate where Parliament agreed: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists...should not have to put up with this''. Firms of your ilk were unanimously condemned as operating an 'outrageous scam' (Hansard 2.2.18). The BPA & IPC were heavily criticised; hardly surprising for an industry where so-called AOS members admit to letting victims 'futilely go through the motions' of appeal and that 'we make it up most of the time' (BBC Watchdog).

    Formal note:
Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service.
    Yours faithfully,
