PARKING EYE Parking Ticket

Hi

I have received a parking ticked from Parking eye but the driver is resident abroad , I been told that although legally I am allowed to give his name and Parking eye usually wont accept for abroad (India ) . Can I name it at next appeal stage or once 29 days are past i cant name him.

Also to note I have received today which marks 15th day form parking however the date of issue is 3rd day . If I understand correct it should be received in 14 days. ( May be delayed in post or they have back log )

I am writing a complain to Aldi , a pharmacy and GP who are based at this parking .

I have made the appeal a rather lengthy from normal so want an opinion. I have used the post 3 from here and added other stuff as well .

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement. There will be no admissions as to who was driving and no assumptions can be drawn.

In order to resolve the dispute I would like you to consider:

The parking is linked to ALDI , XXXX GP Surgery and linked Pharmacy

There were appointment for 2 patients one adult and 1 child and then a lengthy time spent at Pharmacy. A form called FP57 was needed to be filled for one of the patients and it took so long.

Finally some time was spent in shopping at Aldi.

Please note a confirmation by Doctor for both appointments ,FP57 , receipt from pharmacy and copy of Aldi record from Card is attached.

In addition to above there were

Insufficient lighting on signage as it was cloudy day which made the visibility low and appropriate lighting were not done or not switched on or not enough.

The amount you have charged is not based upon any commercially justifiable loss to your company or the landowner so please explain how have you got to this figure.

In my case, the GBP 70 charge you are asking for far exceeds the cost to the landowner. I therefore feel the charge you have asked for is excessive.

The notice to keeper is incorrect
The Notice to Keeper failed to meet the obligations of Schedule 4 of the POFA Act 2012. I received it after 14 days.

Also I would like to get the answer to the following before trying to resolve this issue :

1. Who is the party that contracted with your company for the provision of their services at the site of the alleged in PCN ?
2. What is the full legal identity of the landowner?
3. As you are not the landowner, please provide a contemporaneous and unredacted copy of your contract with the landholder that demonstrate that you have the authority of the landowner to both issue parking charges and legislate in your own name or on behalf of the landowner .
4. Is your charge based on damages for breach of contract? - Yes or no?
5. If the charge is based on damages for breach of contract, please provide justification of this sum.
6. Is your charge based on a contractually agreed sum for the provision of parking? - Yes or no?
7. If the charge is based on a contractually agreed sum for the provision of parking please, provide a valid VAT invoice as you make no mention on VAT in any correspondence.
8. The proof that signage to the site (from a seated position in the vehicle as it enters the car park) is visible and readable on a cloudy day . Please provide a copy of the sign that purportedly forms the basis of the contract entered into by the driver for my records.

Since your PCN is a vague template, I require all photos taken, a clear image of the signage and an explanation of the allegation (e.g. if you have identified a wrong VRN input at a machine, say so, and explain why your Data Protection Officer has not simply rectified it, rather than trying to punish a driver for a matter where there is nothing to deter).

I will be making a formal complaint about your predatory conduct to your client landowner and to my MP, appraising all parties of the debate where Parliament agreed: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists...should not have to put up with this''. Firms of your ilk were unanimously condemned as operating an 'outrageous scam' (Hansard 2.2.18). The BPA & IPC were heavily criticised; hardly surprising for an industry where so-called AOS members admit to letting victims 'futilely go through the motions' of appeal and that 'we make it up most of the time' (BBC Watchdog).

Formal note:
Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service.

    decide if you are naming the driver with a serviceable postal address in India for said driver

    if so, tell them the drivers details now, not some time in the future

    however, if you are NOT naming the driver, use the blue etxt appeal, with no alterations

    the appeal you posted above is nothing like a keeper appeal to a parking company, because the blue text appeal template is all that is needed

    and edit the thread to say PARKING EYE, not Ian Hislop`s magazine

    Get your relative in India to write to PE, in parallel, to confirm that he/she was the diver on the day. They will need to provide some kind of proof that they are corresponding from India - maybe a business card of theirs, pre-printed letter head, postcard with depictions of India, Indian postage stamp on correspondence .... no doubt plenty of other options available.

    I did but that felt to me it is taking more to next stage and I am just trying to kill it this stage. Does the blue text kills parking eye ticket at initial appeal stage as well ?

    if you see the above I have use most of that as well

    So just give driver name and no appeal

    No.
    Parking eye usually wont accept for abroad (India).
    They have to, if the driver lives there and they are given their full name and address straight away.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
