Parking Charge Notice From Private Parking Solutions (London) Ltd

Hi,
I have received a PCN from PPS and it is slightly different to the standard type of PCN. The reason they say I was given the notice is because the Parking For Use Only Whilst Using Site Facilities. However the photos they include are just photos of the car but no photos supporting the reason for the invoice.
I am obviously going to appeal but I was wondering if anyone else has had something else similar and how to best go about it as I am unlikely to get any evidence to support the fact that I used the shop.
The notice is also dated 30th October (taken 6 days to arrive) but the offence is 6th September so is it best to take the route of the request is too old?
Any advice would be greatfully received.

Yes - search the forum for 'left the site' or 'abused patron' threads - there are shedloads if you want to read them, not unusual at all.

Hi I also got a parking ticket at the Tesco Express in Kingsbury. The reason we have been fined is because says that you need to be using the Tescos facility (Parking for Use Only Whilst Using Site Facilities). I use these facilities frequently but on this occasion the Tesco's was closed for refurb! and I have been fined for parking there to then have to go to a different shop around the corner. So I am going to try appealing0

You haven't been "fined" it's an invoice.

It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.
All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.You never know how far you can go until you go too far.0 -

So I followed the advice on the excellent forum - the link is above
My steps were:
1. Subject Access request - what information did they have? I couldnt remember who was driving on that day, yet the ticket was issued in my name. Can they show who was driving? As they should pay the fine right? Ask for all the data they have on you.
2. Received information from them after 14 days. They couldnt show who was driving....so informed them - The operate has not shown that the individual who it is pursuing is in fact the driver who may have been potentially liable for the charge

I also wrote:There is a lack of clear signage at the parking bays which describe the situation of Site facilities being closedTime of photographsYour evidence shows a small A4/A3 sign is displayed on the shop window, however this sign is not clearly visible from the parking bay. I have taken a photo (attached) from the parking bays, which was taken on 4th December at 7:50am, whilst the shop was in the same state - closed for refurbishment. There is no clear signage to show the shop is closed. In fact, the Tesco store has a large poster/A0 size under the main Tesco shop signage saying - "Hello. Monday to Sunday 7am to 11pm." - This clearly implies that the shop is open. Therefore it would be reasonable to think that anyone utilising these parking facilities would step out of their vehicle once parked and proceed towards the shop to attempt to use the Site facilities as someone normally would.Your photographs are taken within the time period of around 2 mins. The driver of the vehicle may have left the vehicle in the bay to walk up to the door and realised it was closed, and attempted to find another way in, or look to use other facilities on the site. They may have been standing by the door, looking to talk to a store representative for a number of minutes. Therefore again, in this situation they would have been attempting to use the site facilities.
3. I have had a reply today from them saying they have Rejected my appeal.
They said -
We have reviewed the points you raised in your appeal. Unfortunately, on this occasion, your representation has been rejected, as the vehicle was parked in contravention of the Conditions of Use.
The terms and conditions of parking are clearly stated on the signs prominently displayed around this site. These include:
TESCO CUSTOMER CAR PARK
PARKING FOR USE ONLY WHILST USING SITE FACILITIES
Parking at this car park is for the sole purpose of shopping at Tesco. According to the evidence provided by the operative, at the time of this parking event, this particular store and its additional facilities (ATMs) are temporarily closed because of a renovation therefore, the car park cannot be used for its intended purpose. It is also evident that no one reads the signs nor attempts to use the facilities and the grace period is not applicable. By remaining in the car park, you contravened the terms set out at the site, as such, I uphold the operative’s decision to ticket this vehicle.
Ultimately, it is the motorist’s responsibility to comply with the terms and conditions of the car park prior to leaving their vehicle unattended on site.
To avoid incurring further administration cost, please arrange your remittance of £60 within 14 days from the date above (we reset the clock). Please note that after this time the Parking Charge Notice will rise to £100.00 if you pay within 28 days and to £160 once we pass the details of your case to debt Recovery Company.
You have now reached the end of our internal appeals procedure. You can make an appeal to POPLA - The Independent Appeal Service by completing appeal form online on popla within 28 days.
I'm not sure how to reply, I have just sent a message (3/1/19) to Tesco on facebook but they said -
Thank you for contacting Tesco.
I'm very sorry to hear that you have received a parking fine under such circumstances however as the car at this store is owned by a third party and not Tesco you will need to contact them to resolve this.
I'm sorry I could not do more in this instance.
