I think their next step will be for them to send me a "without prejudice" letter offering to settle for £165
A bit early to say there is a pattern emerging, but there have been one or two NCP and Britannia (the two big PPCs recently roped in to BWL's latest 'drive') cases where decent defences seem to have triggered WP offers. They haven't yet got to a discontinuation stage, but time will tell - I suspect they will.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I will be keeping a close eye on this thread.

Very similar thing happened to me with NCP car park (Newbury Park Station).

I parked up in the morning came back to pay prior to leaving but the machine was not working.

POPLA also rejected my appeal on the basis I should of phoned the parking company and paid over the phone but this would of been more expensive.

I also didn't read the threads on here and just sent an appeal letter into NCP car park confirming I was the driver thinking they would cancel the ticket but how wrong was I, even though I must of spent £1200 over 12 months using that car park.

i'm just waiting on the summons now.

Also the evidence pack they sent to POPLA had photos of a different car park to the one that I was parked in and the Machine log doesn't list anyone paying around the time when I was leaving the car park.

Have you had a response back from NCP?

I will be writing up my defence in preperation for when the summons comes through and will post it up for comments over the coming week.

    Good luck with your case.

    List to my thread.

As so many of these cashless transaction seem to go belly up, would it not be better if everyone paid cash?
