    No.

Even if it's judged to be mis sold, it's a pre bankruptcy asset
  • Hi
looking for advise on PPI from RBS. We were in an IVA in 2009 and my husband payed back 100% in the pound due to an inheritance. We claimed PPI from RBS but have been told that they are keeping the pay out as he owed interest on an account from 2018. we moved banks in 2009 as RBS was one of our creditors in the IVA.
Don't know what interest they are talking about as he paid 100% in the pound.
    Can they do this.

IVAs often involve the lender accepting a reduced amount as part of an agreed settlement.    i.e. the debt is reduced and they agree not to chase you via the courts.   In that scenario, the debt still exists.  It is just you are never being asked to repay it.    However, PPI redress is allowed to go against arrears, defaults or amounts written off as an agreed settlement.   Quite a logical situation as if you never paid it in the first place (by defaulting with a reduced settlement) then you should not be refunded it.
