the only problem is, and I'm not sure if i'm totally correct, but removing your cards I'm not sure how easy it would be to start over again on ebay and your risking your account for the sake of this 1 record. I completely understand that it's bang out of order on both the buyers part and the fact paypal probably will side with the buyer but you can't let one sale ruin your account. If you considered contacting the buyer before they send the return back to you then you might get them to close the case completely if they think your onto them about what they could possibly be doing and your preared to take the matter further. Tell them you have taken legal advice and just give them a load of cobblers and maybe they might re-consider. Thats the only thing I can think of as some people are just pure tryers. I've had a few try it with things and I'v sent a direct email on a couple of occasions warning them that I believe they are commiting fraud for varying reasons and managed to get a case closed that way.0

As to removing my cards. I cancelled them as lost so I now have new ones and the accounts with PP and ebay have closed account cards now. I cancelled all DD's too. PP and Ebay now have no access to my finances.
With regard to loosing the account, if that is the way it has to go then... I am just not strong enough or intelligent enough to fight this any longer. PP have made up their minds and so I must play their hand of cards and wait. I will let them send collectors and hopefully they will issue a CC case against me. That'll save me some money.
(I am not a huge ebay seller but every one of the 180 odd feedbacks are positive. It's taken me 2 years to get to this stage and so yes I am prepared to loose it all over 1 triple LP set that sold for £200.00. I feel at the moment that it's the right thing to do).
I did send the buyer a message through ebay outlining my concerns regarding 'misrepresentation' (I was polite and to the point - no messing) and thats when he cancelled his claim with ebay saying "I should have asked more questions, my fault" (though he asked NONE he just bid and won) but then got a mail saying he would rather claim with PP anyway. He also sent a message through ebay claiming I was being 'hostile'.
I just don't get it. He is getting away with this fraud and that's what it is. Fraud. I don't con anyone, that's not the way I roll. I prefer truth honesty and leading a good life at the end of the day but this case has gotten me right down down down so much so that I am now loosing sleep and it's the only thing that is on my mind.
I just can't believe all this I really can't. I've done nothing wrong and I know I haven't and yet the PP system is failing me completely. xxx0 -

As it was a high end item, i took photographs of the item itself and the package as I sent it. On the outside of the shrink is an advertisement sticker. It is in the wrong place to the one I sent. As to the damage. before opening the shrink the buyer would have seen this damage to the front cover so why open the item?
Oh I am gonna love proving this scumbag wrong... either to PP or in court...0 -

You need to calmly reply to the dispute that the buyer has returned a different item so you will not be refunding until your item has been returned.
I would also now PHONE PayPal to let them know that you have received a different item back.

same packaging as I sent. no damage... with the LP cover the top right corner has been severely bent right over. this would have certainly been seen through the unopened shrink wrap...

out of curiosity did this buyer have a great amount of feedback? Are they far from you? Did you actually speak to them directly? Paypal probably won't really care about this issue as this kind of thing happens all the time whether vinyl records or something else broken and a seller returns a used item they already own that might not be in working condition. The problem is also the weight will be close to the original weight aswell as it's the same item sent out so not sure where your going to go from here on this one.0

What a dreadful thing to happen to you, it must really dent your faith in people, I sell stuff and sometimes people say the item has not been sent, when I sent a pic of the certificate of posting sometimes you don't hear back from them.
There are lying scumbags out there but lucky for me so far if I have had to contact Paypal I have found them to be fair.0 -
Whilst its frustrating for you, you are dealing with Paypal.
Bottom line is photos prove nothing, you can take all the photos you want but that doesn't prove you sent the item in the photos.
You see sellers can be just as big crooks and liars as buyers so who do Paypal believe.
They err on the side of caution and refund, almost every time and all you get for complaining to hard is your account closed.0
