Hello again. This what I received from CCBC:

"I am writing in regard to your recent claim response. Unfortunately your claim response has been misplaced.

Please send us a copy of this document either by post at the above address or email by 14.08.2019. Please note your case number and ‘claim response’ in the subject line of the email.

Any copy forms can be located here: https://www.justice.gov.uk/forms

Please be advised that if you do not provide a copy to us, the claim will be referred to a judge for directions. This may lead to a judgment being made against you.

We apologise for the inconvenience caused."

I just want to make sure that I am sending the correct forms. I filled in the acknowledgement of service on line. Do I have to download a form now and fill it in again? Shall I forward my defence and DQ as well?

Do the AoS online and send your Defence again as described in post #29 above.
If you can't redo the AoS online, send the form by email as for your Defence.

Send a copy of your completed DQ to the CCBC in the same manner and to the same email address that you sent your Defence.
  • Hi. I have not visited the forum for a very long time...I received Notice of Trial Date during Christmas holidays (how nice!) and since I have been really busy at work completely forgot about it until today when I received witness statement from the Claimant. The letter from the county court does not include any instructions to provide a witness statement so I completely forgot about that.
If the trial is on 4th February, do I still have time to file it? Am I at disadvantage if not?

Check the back of the court letter , it's usually 2 weeks before but can vary

    Get on with the

WS plus Exhibits plus costs schedule , now !!

If you don't do what the court has told you to do , it's probably game over

    Get on with it asap

Yes it does. On the back. It tells all parties what to do and when.

Yes, and hurry up. Show us your draft WS like everyone else with a late WS case. Happens all the time.

Search the forum for never too late witness statement and please read CEC16's thread as well.

I see with some concern, that you've not been here since August, so unless you've been keeping up with the forum (I hope you have) you maybe missed what happened at Southampton court, that you can use against the falsely added £60 in your own case.

Read the thread by CEC16, and you may have also missed that we always now tell people to file & serve their costs schedule in advance, as well as a SUPPLEMENTARY WS.

Read more threads first! Now, tonight. This is a SIMPLE but VITAL stage.

Do not try to show us their one, we see it all the time. It's a template.

  • The letter does not include any specific directions regarding witness statement.

It only says: Any application in the case must be made to the court where the case is to be tried.

You are looking at the wrong bit. This is not an application.
