Personally I'd recommend you to do what we did: appoint guardians who would not necessarily take the lad on, but would decide what was in his best interests at the time. This means you don't have to be second guessing what might happen, how long your parents might feel able to take him on, etc etc etc.
thanks for your reply. Did you appoint your guardians within your main will or as letter of wishes attached to your will? If so does the letter need to be in legal "speak" and witnessed? or just a general letter outlining guardians etc??0 -
I think we put it in our will, although I'm not sure it has any legal standing IYSWIM because if we'd both died I think social services would have to be involved, just to confirm that the arrangements were 'safe'.
Although my understanding is that if a family member offers to take them, there would have to be strong reasons not to let them.Signature removed for peace of mind0
