Business court

Hi,
i received by post a letter from the northampton county business court today for parking fines from a private parking company. I have been ignoring the parking invoice for the 3 months.

please could you kindly advise?

    Please read the stickies/FAQs. On no account should you continue to ignore this.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed in the house as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an
    M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
    You never know how far you can go until you go too far.

    the parking tickets in question are from a hospital accomodation car park which was free but they suddenly changed to charging for parking. I didnt notice the change untill i started receiving parking invoices from parking eye.

    do i have to pay this sum?

    Only if ordered to by a Court. Have you been? (Is the letter "asking you to pay" actually a Claim or a judgement?)

    #2 there covers Court claims right through to the hearing, and how to defend them


    (You haven't been "fined"!)

    Though take the idea in #2 above that they will be out of business next month with some care.

    It's highly optimistic/unlikely etc and you should not miss any deadlines in dealing with this thinking no need!!

    There are hundreds of threads on this forum already with a wealth of information in them.

    It is really disheartening for regulars who have the best advice to give to read such a basic lazy post from an OP who hasn't obviously taken time to even research other threads, plus the NEWBIES, before posting.

    Just see how many active threads there are on here. EWe just don't have the time to spend on people who haven't invested a little of their own time before starting a thread.

    Have you tried reading whatever it is that you have been sent? They usually tell you what you need to do.

    If it's a multiple choice then at least give us a clue as to the options.
  • Sorry I didn't get the details or clearly understood the letter before posting.

    However, I received a claim form from court county business court on behalf of parkingeye claiming £485 . This is for ticket invoice on parking in private hospital accommodation car park.

    I want to appeal. If I lose will it appear on my credit profile or will just be asked to pay the amount?

    HOW YOU CAN GET A CCJ (County Court Judgement)

    1: They must firstly take you to court
    2: You have the opportunity to defend
    3: A judge will rule who is the winner
    4: If you lose (doubtful), the judge will make
    an order for you to pay (normally with 28 days)
    5: If you ignore the court and do not pay, then
    you will get a CCJ
    6: However if you do pay as the court orders,
    that is it ...... NO CCJ .. NO ENTRIES ON YOUR
    CREDIT FILE

    DANGER POINT .... If you ignore official claims from
    Northampton ... A county court claim, DO NOT IGNORE
    If you do ignore you WILL end up with CCJ by default.

    If you wanted to appeal you should have done at the time.

    £485 makes no sense for one PCN.

    Please read the NEWBIES thread 2nd post as you've been told to read, it explains all. You get NO CCJ of you lose and pay.

    What is the date of the claim form (top right) and what EXACTLY do the PARTICULARS OF CLAIM say (left hand side of the claim)?

    Date of claim- 31/10/18.

    Particulars of claim:
    Claim for monies outstanding from the defendant, as registered keeper , in relation to 4 parking charges, issued between 20/07/18 and 31/07/18 for parking on private land in breach of the T+C's (the contract). Parkingeye's automated number plate recognition system, monitoring Grindley Hill court, stoke-on-trent ST4 6TA, captured vehicle GT**** entering and leaving the car park, parking without authorisation. The signage, clearly displayed at the entrance to and throughout the car park, states that this is a private land, is managed by parkingeye Ltd, and authorisation is required to park, along with other T+C's by which those who park on site agree to be bound. In accordance with the T+C's set out inn the signage, the parking charges became payable. Notice under the POFA 2012 has been given under sch 4 ,making the keeper liable. This claim is ref to parking charges *****,*****,****** etc
