Any success with CM services ltd £100 notice

    It sounds like you are wanting to pay them?

    The reason for delaying the appeal is to deflect them from accessing your data from the DVLA, without which they cannot hold the RK liable (Protection of Freedoms Act 2012 Schedule 4).

    You'll have to probably convince a Judge much later in the process because initial appeals don't return cancellations from the PPC (whether IPC or BPA operator) and with IPC operators, the second stage appeal to the IAS doesn't work either.

    If you're wanting to pay nothing you take your chance by digging in for the long run (up 6 years - there are thousands doing so, don't be intimidated by that timescale).

    But for further advice you need to start your own thread.

    I have just noticed that the NTK was issued 1 day after the alleged contravention occoured, and that's in addition to the parking ticket served on windscreen.



    Am I right to assume that it invalidates the PCN as:
    '(Where a notice to driver (parking ticket) has been served) Not earlier than 28 days after, nor more than 56 days after, the service of that notice to driver'

    I have received an NTK from CM Services LTD that was issued 1 day after the alleged contravention occoured, and that's in addition to the parking ticket served on windscreen.

    Am I right to assume that it invalidates the PCN as schedule 4 of paragraph 9 of POFA requires the NTK to be issued:
    '(Where a notice to driver (parking ticket) has been served) Not earlier than 28 days after, nor more than 56 days after, the service of that notice to driver'



    If I'm right, should I use this in the appeal?
