Builder refuse to take my skip

    Agreed - contact the number on the skip.

    Worst case analysis situation - after making every attempt possible (and keeping proof of it!!) put a notice up on local Facebook group (with photo of skip) saying "I've tried this/that/that to arrange for skip to be collected. I hereby give notice to any interested parties that you have until date 14 days time to collect it. After that time - I will arrange to sell it and I will be keeping the proceeds".

    Some mate or other of the builder or skip firm supplier will see this - if he doesnt.

    Take a screenshot of your post to prove you've done this - if someone comes "knocking on your door" for it if the 14 days expires and no-one has claimed it (to prove you are the one entitled to the money from selling the skip).

    The law allows for people being able to sell unwanted goods if 3 months has elapsed and the owner hasn't collected them (after being due notice to do so).

    so I got in touch with the builder (after many attempts), he just said the skip company went bankrupt so he stated it not his fault. Since no one is going to collect the rubbish (the skip is left on the quiet public road,so doesn't impact the people) and he said I will need to pay another skip company to get rid of it, which I refuse ,as half of the rubbish in that skip doesn't belong to me.

    Because the skip been left there for so long, another people just stacking up their rubbish there. I also informed the council, half of the rubbish in the skip doesn't belong to me and I should not been paying full price to get rid of it. What could be the best option I should do now?

    If it was the builder then irrespective of the skip company no longer being in business, it is still his responsibility to get rid of
    Even though the rubbish was placed in the skip without your permission, it is now your responsibility to dispose of it correctly.
    This is no different to landowners whose land becomes the target for flytippers and who have to dispose of the rubbish dumped on their land.

    If your builder refuses to do anything, your best bet would be to either contact other skip companies and see if they will collect (although you will probably have to pay), or ask the council if they could arrange collection, but again, this will be chargeable to you.


    Once it's gone then there is nothing stopping you from taking legal action against the builder to recover your costs (providing that it was the builder who arranged the skip contract).
