And after 6 months from purchase the burden of responsibility (for proving the fault was inherent - present but not apparent at the time of sale) switches to the consumer, so the seller can require the consumer to prove (on the balance of probabilities) that the fault was inherent.0 -

If you take the watch to Apple yourself you know exactly what has happened to the watch.
If Argos take it back they will send it to Apple. If Apple say it is damaged was it damaged before Argos got it or was it damaged after Argos it?
I would rather be in control of my watch until handed over to Apple.
That way I can deal with the person checking it, not a third party.0 -

go on live chat with apple, they will send you a box, send to apple they send a replacement by return, pretty quick when i sent a ipad to them

If argos are only telling you they want to send it off to apple for assessment first then thats fine. If they are saying you need to send it off then thats not - they can of course elect any agent they want to carry out their tests, but they can't make you deal with their agents. Your contract is with them and they can't assign obligation (aka their liability to you).
However its going to come down to how quickly you want a resolution - sometimes the manufacturer isn't the best option as they can charge postage or perhaps warranty doesn't cover something that statutory rights do, but if thats not the case then often a warranty can offer a quicker resolution with the least hassle.
Although one issue to consider is if it goes missing or is damaged en route to apple - it could complicate matters and be more difficult to claim from them than it would if it was argos who were responsible for sending it.You keep using that word.
