No ticket/wrong address - PCN, debt collectors

I've read the newbies post and seem to have a feel of how the world of parking charge notices work - I think! But could still do with some help. I have just picked some post up from our old house and there are four parking charge notices for the same location - private car park where other half parks for barbers. He didn't pay to park on each of the occurrences. The letters have also gone to our old address as he had not changed his address on the log book or his driving licence. So until right now we had no idea that he had parking charge notices.

So...
We now have debt collection letters which are saying if we do not pay they will forward to solicitors - have seen on the newbies post to ignore these.

The aim of this post really is to ask for advice re where we stand IF he is faced with court with him not paying for any tickets at all and not having changed his address.

    first tasks are to get the correct address to the DVLA for both the driving licence and the V5C, otherwise they can fine the person up to £1000 for each offence

    next thing is to inform the PPC of the correct address for service of papers, including any future court claims , so send them a DATA RECTIFICATION NOTICE under the GDPR and give them the new address (like needs to be done with the DVLA)

    keep a copy and get a free postal receipt from the P O Counter (not signed for, just a free proof of posting) and keep it safe with the copy

    the PPC has 6 years to issue a court case using MCOL, in which case the defendant defends it which is covered in post #2 of that sticky thread

  • Other half is changing addresses tomorrow so that's the first thing done. Apologies if this has already been covered somewhere, but how do we go about sending a data rectification notice, and would that need to be sent to Civil Enforcement Ltd? Also, to be a pain... Would we have the same chance of winning with him not paying for tickets at all and having the wrong address initially? Will read #2 now. Thank you very much, really appreciate your reply.

    send it to CEL

    you can also send it to DRPL as well if you like

    the fact that the papers went to the old address is because some fool didnt update the V5C with the DVLA, so talking about that topic wont help anyone

    what you dont want is more paperwork to go there, hence why you rectify that by informing CEL (and maybe DRPL too) of the correct address of the keeper, keeping a copy of this notification in case a court case happens (you dont want a default CCJ registered with the old address)

  • If cases are taken to court, does the amount you have to pay increase? So, the amount of the parking charge notice plus debt collection fees and other charges? Or just simply the amount of the PCN?

    How old are these tickets? CEL are very quick to issue court claims especially for multiple tickets and where there has been no response. It's apparent that they see the possibility of gaining a default judgment in their favour because of undefended case(s) as being next best to them being paid.

    Has your OH checked his credit rating recently?

    its the costs of each and every pcn plus court fees and legal charges

    a typical cost for one pcn is £100 + £75 in court fees etc = £175 in total

    ADD the costs of the other pcn,s onto it, so possibly £475 if a court case was lost for 4 pcn,s

    this doesnt stop the PPC and debt collectors and solicitors trying to bolt on their fees , which the defendant will be objecting to

    Cost of the ticket (PCN)
    £25 court fee
    £50 legal fee
    Maybe a small interest charge
  • The first is from May of this year, and this is the one that we have debt collector letters for. The others are still just PCN's with no further letters being sent as of yet.

    I need to read up on defending in court, I'm not sure how much of a chance we would have in having the PCN's discarded. Don't want to end up paying more through not winning at court than if we paid now.

    No, he hasn't checked for a while.

    OP, can I guess your surname from your forum username?

    Then your really should ask MSE to change your username to something totally anonymous.
