Boiler packed in - house being repossessed - who's responsible?

    I appreciate all replies. It's been a stressful couple of days.

    Update:

    The lender is denying responsibility as it wasnt a binding tenancy.
    The landlord ... - no comment.
    Local council environmental team said its the lenders responsibility.
    CAB said it's my landlords responsibility as the lender doesn't become the owner until they have physically taken possession of the property ...

    So I was non the wiser really. But I took CAB advice as most likely.


    I bit the bullet and paid £200 for a gas engineer. I used the money from savings we were saving for a bond / rent for new accommodation in January.

    So we have a functioning boiler at the moment.


    We are now waiting for a notice of intent from the lender then we will apply to the court for the maximum time allowed to stay. Hopefully the judge grants it and we can get Xmas out of the way and move in January.

  • Rent had always been upto date.
    However, he was due a payment on the 1st of November. Which I have held back and put into a pot to hopefully sweeten any potential deal with the lender about staying for an extra 2 months. Im willing to pay rent directly to them until we either move of our own accord or the bailiffs come to change the locks.
  • I'm also considering sueing my landlord afterwards for damages / storage costs etc, but like someone mentioned above,
    You can't get blood out of a stone. And if he's got no money, I would be throwing money away chasing him

    Keep receipt for plumber. Deduct from rent if/when it becomes due.
