How can I evict my tenant in rent arrears when I didn’t protect deposit

Maybe the tenant is in work but is still eligible for housing benefit or perhaps the tenant cannot physically work. Who knows? The hows and whys are not relevant to what the OP needs to do in order to gain possession of the property.

Renting in the UK is a joke when it goes wrong.
The Law to be honest is wholly on the side of the Tenants and allows them to scr*w the landlord for Thousands of pounds and month and months of aguish.
In this country, the Landlord has to abide by every single little rule and regulation when renting out property and if they don’t then the full force of the Law is on their back.
Yet, if the tenant decided to stop paying and refuses to move out or damages the property, that’s the landlords fault too J
As it stands, when the tenants play up, it’s all on the Landlords head. The authorities are not interested, and the icing on the cake is that the Landlords still have to make sure the property is maintained, safe and every rule is followed.
Whilst the pi*s taking tenant, that is living rent free sits there and laughs at the Landlord because he/she knows there is NOTHING that can be done to remove them without a long and costly legal battle costing even more money and effort.
In my opinion - In this country the Tenants are legally allowed to take the pi*s.
It should be that - If someone can’t afford to pay the rent (for whatever reason) - then in my opinion the council should step in and either:
- Pay the Landlord the rent - if the tenant qualifies for housing assistance (or)
- Find then alternative council accommodation.
Or
- If the person is not eligible for council help then the Landlord should legally be allowed to kick the tenant out after 2 months of Rent arrears with proof of no rent payments for atleast 2 months.
Why is it that the Council and CAB tell the tenant to stay put until the Landlord serves notices and waits months and months for court hearings and evictions costing them thousands in lost rent and legal costs not to mention the mental aguish.
How is that fair.

Your alternative means the taxpayer stepping in to protect the risky investment you voluntarily took on. Being a landlord is not free money. Unlucky.0 -

That's the thing though, perhaps when it goes wrong the tenant does have a lot of power, but this is vastly outweighed by when it goes right.
As a LL myself I often think its almost unfair how much you can earn from a good tenant. So it would be hypocritical to moan when you get a bad one.
At the end of the day being a LL is a business and if you choose to be in this business then you must abide by the rules, or do something else.0 -
