    It is not a fine, it is an invoice for alleged damages for an alleged breach of contract. In reality is was simply a very minor human error. A local council would, almost certainly, demand considerably less for a similar transgression. IT IS A SCAM.

    If the restaurant will not cancel, write bad stuff on their TripAdvisor/Facebook pages, that usually gets their attention.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed in the house as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an
    M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.

    You come across as very straightforward in your thread and I think that counts for a lot when complaining to managers of premises. Just one thing though, I was struck by the fact that you had just come off a late shift and were tired ... who doesn't take their eye off the ball at such times? Might well be worth a mention.

    Its now the 2nd from last day i can apeal so here goes!

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement. There will be no admissions as to who was driving and no assumptions can be drawn.

    Since your PCN is a vague template, I require all photos taken, a clear image of the signage and an explanation of the allegation (e.g. if you have identified a wrong VRN input at a machine, say so, and explain why your Data Protection Officer has not simply rectified it, rather than trying to punish a driver for a matter where there is nothing to deter).

    I will be making a formal complaint about your predatory conduct to your client landowner and to my MP, appraising all parties of the debate where Parliament agreed: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists...should not have to put up with this''. Firms of your ilk were unanimously condemned as operating an 'outrageous scam' (Hansard 2.2.18). The BPA & IPC were heavily criticised; hardly surprising for an industry where so-called AOS members admit to letting victims 'futilely go through the motions' of appeal and that 'we make it up most of the time' (BBC Watchdog).

    Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service.

  • Blonde moment, right i have sent the above appeal, i stated im keeper, didn’t mention driver and i enclosed a screenshot of a payment from the pub (online banking)

    I know this will probably be rejected but hey, let the battle commence lol
  • My sister stayed at a Premier Inn. She paid for parking. Parking Eye said she hadn't and demanded £100. She spoke to the hotel who agreed that she has paid for parking but said take it up with Parking Eye. Parking Eye telephone number does not connect you with a human. I do not see why she should have to go to Popla to appeal a ticket that she should never have received. Premier Inn took her parking payment but have washed their hands. This seems to be kafkaesque

    No they didn't. They never make it clear but they will be alleging a typo in the VRN, I expect, as an excuse to extort £100 from her.

    She MUST do POPLA (but after reading the sticky thread about POPLA stage and after reading Parking Eye examples). Would she rather be sued, as PE do every day? Do NOT just get annoyed and let her ignore or sideline it or she'll be seeing them at her local court in a hearing in 2019.

    You/she need to read the NEWBIES FAQS thread and other POPLA appeals and start a new thread.

    And she needs to submit a Rectification Notice using P/E's Privacy page form, stating that she wants to know the data they are working from - including a list of payments made at the time and partial VRNs, so she can identify the payment made - and if the allegation is an incorrect VRN, she requires that P/E rectify that inaccurate data which will have been a fault of their keypad and system, not the driver.

  • Right, iv been in touch with whitbread who own the pub, they said theyl make contact with the manager and asked me to speak to them aswell.

    Manager said no can do, so i went back to whitbread and basically it all repeated itself. So no joy by the seems of it, even with a bank statement showing that i was a customer.

    Today, i got my rejection letter from Parking eye as expected, took a while but its here now. Right, popla it is then i guess, i have the popla reference number, just got to find a nice template to base my case on, il post it here before i send it for feedback :)

    The NEWBIES FAQ sticky, post #3 tells you how to construct a POPLA appeal and includes template appeal points to use. Use as many as you can, provided they are relative to your case.

  • Yeah had a quick look through earlier, im going to send a few more emails to the land owner, see if i can get them to say something along the lines of i was ok to park there etc to add to my appeal.

    Aside from the template and its contents, anything you would add into it?
