    Everything is much more complicated with the UC rollout!

    hazzer619. Further thought. There is no need to stop your CA claim. Just tell ESA that you currently get it and the DWP should sort it out and stop paying you the CA. If you do find you get paid both by mistake let the CA unit know. Although the DWP will stop paying you CA this does not end the CA claim, you retain an 'underlying entitlement' if you still meet the qualifying conditions.

    If after your Work Capability Assessment you are refused ESA you will then simply have to ring CA and ask them to start paying you again rather than make a new claim. Similarly if you are put in the Work Related Activity Group and your ESA ends after 12 months you will simply need to ring CA and ask them to start paying you again.

    Thanks Calcotti, actually the person i care for has just gone into a home permanently so i will be stopping CA on monday to coincide with the new CLAIM for ESA

    Nannytone has misunderstand the implications of the OP being in a UC area. He will be unable to claim Income-Based ESA as this legacy benefit now comes under UC.

    The benefits landscape is now very complicated following the introduction of UC, and its interaction with legacy benefits. It makes giving advice, without sight of all relevant paperwork and knowledge of all the circumstances, very tricky. We will all make mistakes, and as the OP posts more info or clarifications our advice may change.

    To respond to a fellow forumite trying to give sensible advice to an OP in such an outspoken and, frankly, unpleasant manner ( "You have a bad habit of not actually knowing the full details of the advice you give") is unfortunate. It is also inaccurate and suggests to me that Nannytone's knowledge of the benefits landscape may precede the current era in which UC co-exists with legacy benefits, and again suggests to me that her knowledge is now outdated. It is a pity she hasn't apologised for her overly forthright remarks.

    For the OP - like poppy, I agree with Calcotti's analysis.
    Alice Holt Forest situated some 4 miles south of Farnham forms the most northerly gateway to the South Downs National Park.

    It would help when asking for advice that includes UC if posters could give as much info as possible, and if we all showed a little more patience, good manners as my dear old mum would say "cost nowt".
