    That was what C-m and I were addressing.

    Had you previously received a Claim Form?

    No. Just the Judgement for Claimant notice which we received a few days ago. Prior to this was a standard threat letter from Gladstones which was received in August.

    Right, so stop thinking you can just refuse to pay, and do as advised:
    If no Claim form arrived, then complain to the CCBC at Northampton, because they screwed some claim forms up on 13th September (they forgot or failed to post claim forms out at all, then issued Judgments in Default) so maybe it's happened again.

    This is more serious than you seem to realise and you can't just get a solicitor to fight a Judgment in Default, you need to complain to the CCBC saying no Claim Form was ever served and you know they 'had problems' and were recently issuing apology letters to people so why have you not had one, and why have you had a Judgment in Default?

    You may have to stay on the phone for some time, and escalate the complaint. DO NOT give up, do not think you can just not pay it, as you WILL (next month, if you do nothing properly/do the wrong thing like moan at Gladstones) get a CCJ ruining your credit rating for 6 years.

    Because they have issued a claim in the SCC. The Law requires that you defend or settle. It is not a fine, it is an invoice for an alleged breach



    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed in the house as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P.
    for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
    You never know how far you can go until you go too far.

    The Deep - Thank you my friend. I have now sought some very good practical advice and now have a sense of direction. I have already drafted a letter to my MP in the hope he would perhaps liaise with his colleague Sir Greg Knight MP whom I believe is trying to push the Bill you mention through parliament. I will check out that link when I can get a decent WiFi. Our village is atrocious of such advances in technology!

    Write as many letters as you want if they make you feel better but don't forget the most important task of dealing with your impending CCJ.


    From what I've gathered (after being on here 8 months approx.) it would be wise to pay the judgement THEN start the fight around getting it overturned and hopefully making someone pay (obviously at a later stage) for THEIR mistake.

    I cant disagree with you Ralph PROVIDING the op doesn't run out of time and the CCJ is 'rubber stamped' I think majority on here are familiar with how clogged up the court system is and if any input is required from Gallstones god help him!
