Below are a summer of details which id really appreciate some guidance in. I have already completed my AOS.
-I was parked in south London, camberwell, butterfly walk, Morrison car park on the 8/2/18
-The total duration of my parking was 15 minutes
-I did not know the carpark used number plate recognition and thought it was a manned carpark so thought I was safe with my parter and step child in the car
-My only reason for being in the car park was because my step child urgently needed some medication which I ran to get from Superdrug on the main road.
When I received my initial notice, I appealed explaining that I had someone in the vehicle and the urgent situation I was in. This was rejected and have ow received the claim form from the county court business centre.
I would like to know if there are no grounds to dispute this charge or if there is a defence that will help in this matter.
Thanks,
Paul

The only defence that might work is that the urgency with which you needed to go to Superdrug meant that you didn't have time to consider the contract you were entering into by parking.
I very much doubt that this will work. The child would have to have been so ill that you should really have go to A&E for this defence to work. However, if you have a prescription for the medicine and can explain the child's condition to the court, you might prevail. The comments I post are my personal opinion. While I try to check everything is correct before posting, I can and do make mistakes, so always try to check official information sources before relying on my posts.0 -
So what terms and conditions did the driver breach?0

That's over three weeks to produce a perfect Defence. Plenty of time, but don't leave it to the very last minute.
When you are happy with the content, your Defence should be filed via email as described here:
1) Print your Defence.
2) Sign it and date it.
3) Scan the signed document back in and save it as a pdf.
4) Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
5) Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
6) Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
7) Wait for your Directions Questionnaire and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.0 -

No, that's not how to write a defence to a parking scammer claim. The OP needs to ignore that, and read the NEWBIES thread 2nd post all about how to successfully defend a parking ticket claim, whatever the circs. It might well be won on unclear signs/no contract seen or agreed, by the sound of it.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
