Horizon managed/Council owned development car park. FOI response.

The new development consists of flats,retail units,hotel and a cinema. A multi storey car park has been built on land that was formally a Council run public car park.
It is privately owned by the service charge company that leases the land from the Council.
The service charge company is owned by the Council.

1. A breakdown of the £17681 annual cost to XXXXX Council from the
contract with Horizon Parking Limited.



The breakdown of the charges are:



Management fees,

Processing PCN’s

Signage for the Multi-storey Car Park and surrounding car parks on the
XXXXXXXXX development.

Rental of ticket issuing devices for XXXXXXX Staff to police their
car parks





2. The number of Parking Charge Notices issued by Horizon
Parking at the XXXXXXXX development between XX/10/2016 – XX/10/2018

Horizon Parking only process parking charges for those who have used the
XXXXXXXX Car park and have left without paying. Horizon Parking only
issues parking notices to repeat offenders (more than once).



3. The number of issued Parking Charge Notices paid by the
Keeper/Driver.



148



4. The monetary value of these paid Parking Charge Notices and
to whom the money goes to.



£4,727. The charges and indeed all car parking income is paid to XXXXXXXX
Services (XXXXXXXX) Ltd who administer the service charge budget
and account on behalf of the Council as freeholder. The income goes into
the service charge budget to contribute towards the cost of car parking on
XXXXXXXX. The net cost of parking is paid directly by the tenants
of this private development.



5. The number of issued Parking Charge Notices cancelled
without payment.

6. Does Horizon Parking Limited have the authority to pursue non
payment of Parking Charge Notices through the County Court system?

    And the repeat offender could be:

    - partner, relative or friend of the previous driver

    - a proud new owner of a car bought last week!

    You could ask the Council for their minutes of meetings and discussions and the tender process, that resulted in Horizon being appointed and any information regarding how they concluded - and who concluded, and did they seek legal advice - regarding the Government's position that Councils cannot enforce off street parking on any Council land, outside of the TMA 2004, as if it was private land (with parking charge notices instead of proper PCNs with a statutory process).

    As per Goodwill (DfT Minister) letter FROM 4 YEARS AGO, and the DVLA's position too:

    Remind them that Wycombe Council were banned by the DVLA for doing something similar.

  • our friend Simon rigby is having a field day in preston (NW carparks) he has leased 2 floors of the car park over the bus station , permit only , fomb entry , but jet issues multiple tickets for over line (bays designed for cars in the 70s) and non show of permit - remember this is fob entry
