ECP/Morrisons cancellation with receipt.

Car park signage states '2 hr maximum stay'. Vehicle left car park after 4 hrs+ and NTK received within 7 days.
Appeal by RK was a simple ' RK is not liable for this charge' , and a copy of a £10 receipt from Morrisons cafe included.

Cancelled as a 'gesture of goodwill'......

    ECP are saying that any further contraventions won't be cancelled. That suggests they are retaining your data for purposes beyond its primary intent. What exactly are they threatening here? How do they intend to prosecute their threat? Are they maintaining secret files for this site? What about other sites?

    Time for a letter from you to ECP, with cc (and copy of the ECP letter to you) to the DVLA and the ICO perhaps?

    I agree - another ICO complaint beckons.

    To keep a keeper's VRN data for that purpose (to keep tabs on previous cancellations) must be 'excessive & untimely', because:

    - the car could have a different driver each time, and the driver is the first person liable

    or

    - the car could be sold next month, and then would ECP say 'tough. the previous rk - a complete stranger from another city - had one cancelled...'?
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Amazingly the Parking charge notice I received is the last one ever to be cancelled for over staying the time limit....

    Thank you for your email of XXX October about the release of information from the Driver and Vehicle Licensing Agency’s (DVLA) vehicle register.



    I have read the letter from Euro Car Parks that you kindly provided. Unfortunately I can find nothing in that letter stating that they are storing your personal data for future use. The last paragraph you refer to only advises that if any further PCNs are issued for the same reason i.e. Parked for longer than permitted, that the PCN will not be cancelled.



    As you are aware the company in question Euro Car Parks are members of the British Parking Association (BPA) which is an ATA for the parking industry. The BPA’s code of practice is published on its website at https://www.britishparking.co.uk under the heading “Approved Operators Scheme”. If a member of this AOS does not comply with the code of practice, it may be suspended or expelled, during which time no data will be provided to it by the DVLA. If you feel that any of the practices used by the company did not comply with the BPA’s code of practice, you may wish to contact the BPA at Stuart House, 41- 43 Perrymount Road, Haywards Heath, RH16 3BN.
