Hi, I parked on some waste ground in Cornwall. Riviere Towens car park. I have blue badge but bought a ticket anyway. Time was running out so i went to buy another but had trouble with the coins as someone else did on this site. by the time I returned the ticket was on the screen. The barman in the pub said they are always doing it, dont pay as they cant enforce it. The fine has gone up now to £200 and im starting to get worried. I dont know what to do . Any advice on AS Parking.

THEY CAN DEFINITELY TAKE YOU TO YOUR LOCAL COUNTY COURT WITHIN 6 YEARS and try to enforce this alleged debt
the BB has no legal function on private property
only a judge can decide if you owe them money and if so , how much you owe, plus legal fees , in theory its about £175 if you lost, or less
this could be say £100 parking charge and £75 in court fees and legal costs
on the other hand, you are covered by the EA2010 and so may have a claim against A S or against the landowner, or both, as they need to provide "reasonable adjustment" due to your disability
so its either pay in full, or fight
if you decide to fight, you respond to either an LBC, or an MCOL in the post, or both if they issue both (or a proper solicitors letter), but not debt collector letters
the NEWBIES FAQ sticky thread is 3 threads down from the top of this forum, and although there is a lot in there, its free and contains all you need to know about well known sc@ms like these
so you only owe money if a judge says so, in court, so in your local county court if you require a hearing0 -

Yeah that barman kept repeating, "don't pay it, they have no power as they are not the council".otherwise I would have paid it by now but since reading some of the info on here and what you say it looks like maybe they have no right as I made every effort to pay and still have a previous pay and display ticket. why isnt the law more straightforward? BTW what is POPLA, BB, LBC, MCOL ?

Yon barman is what is commonly referred to as a "barrack room lawyer," which is another name for someone who doesn't know what they are talking about but likes people to think they do.
Either that or he is getting a payoff from the scammers.
