ParkingEye Stress!

Thank you for taking the time to read this. Its probably like many others, but i am stressed out, losing sleep and don't know what to do.

I've reserved a letter from ParkingEye requesting payment for £100 for a 10 minute stay in a car park that the manage. So far two letters have come through the post. From some googerling and talking to friends, i have been told to simple ignore them. About a week and a half ago, a new letter came through stating:
(I cant insert an image as i'm a new member.)

"Dear Sir / Madam,

We are writing to inform you that the requirements of Schedule 4 of the Protection of Freedoms Act in respect of keeper liability have now been satisfied and as 29 days have passed from the date notice of the Parking Charge was given, ParkingEye now has the right to recover any unpaid part of the Parking Charge from you, the registered keeper.
The amount payable is £100.00. This payment is required within 14 days to avoid further action.
If this letter is ignored, further action may include referring to a Credit Reference Agency to confirm the correct address, instruction of solicitors to secure immediate payment, referral to debt recovery or the issuance of court proceedings, all of which could incur further costs which may be added to the amount owed. To avoid further unnecessary costs or action, please pay the outstanding parking charge amount as stated above or make arrangements for the driver to pay, in accordance with the parking terms and conditions. Further information, including how to pay or appeal, can be found on the reverse of this notice.
Please be aware that on 4th November 2015, the Supreme Court dismissed the further appeal lodged in relation to the matter of ParkingEye v Beavis [2015] UKSC 67. The appeal concerned the value of ParkingEye's Parking Charges and the Judgment, granted in ParkingEye's favour, delivers a binding precedent in respect of the value of the Parking Charge. What do i do now?

I simply don't have £100. I don't even have £20 to my name. I've ignored all letters so far and i have not made any contact with the company. The letter shown above is scaring me and i'm starting to loose sleep over the matter. Can anyone reassure me? To my knowledge they have to take it to court before they can send people to my address, correct? And isn't the fact that the DVLA gave them my address against GDPR Legislation?

Am i okay to just ignore this, and if i get called into court hope that they rule that that the fact they want £100 for 16 minutes of idling is reticulated.

Thank you for your help. I am loosing sleeping and stressing out every day about this matter. I can't afford to have people banging on my door to take away my house. I don't have much and i can not afford this "ticket".

    No you cannot ignore these letters.

    The law changed 5 years ago. Who ever told you to ignore is talking out of the back of their xxxx

    Parking Eye are very litigious


    You said the overstay was 10 minutes? Is that what PE say
    Private Parking Tickets - Make sure you put your Subject Access Request in after 25th May 2018 - It's free & ask for everything, don't forget the DVLA :D

    That letter is designed to frighten you and a you are a long way from anyone turning up at your house.


    Indeed if Parking Eye actually engage their debt collectors (who are powerless) it would be a good sign, it suggests the land owner won't sanction court action.


    Where was this car park, who owns it?



    Perhaps the idiots that told you to ignore will help you financially now they have dropped you in this mess.

  • So, I can just sit back and wait for some guy to come to my door and tell him to go away? Or would it be best to pay the ticket?

    I have not acknowledged any letters form parking eye, nori have I logged into their online payment or appeals system. Should I do this or just leave it?

    Stop, please, simply read the NEWBIES thread and wallop in the template appeal online. Lucky for you, PE deal with even late appeals.

    Meanwhile, once it's in, then IMMEDIATELY complain to the onsite retailer/company/hotel and get it cancelled that way before you even get the rejection letter.

    No, that doesn't happen. What on earth makes you think bailiffs can just be sent round without a court hearing first?
    Or would it be best to pay the ticket?
    And...no!

    With friends like yours, who needs enemies?! Madness to ignore this, unless the land was in Scotland (which it can't be, due to that letter).

    You absolutely CAN blank them. They sent me one last year for parking on a retail car park. Next step they send them with red print all over them because apparently that's more intimidating.
    Then I got a couple of letters from a collection agency. Then a couple from a different agency!
    I blanked them all. Haven't had a peep since.

    Do you understand that they have up to six years to seek a remedy through the courts?

    WRONG WRONG WRONG, dangerous advice.

    Please stop posting where you have no idea as to the actual truth. PE usually sue, and only have a few sites (Aldi, for example) where they never sue.

    Ten of thousands of people every year now get a PE court claim. We know how to beat them but it's NOT by ignoring.
