    I understand now but maybe the defence should say that, leaving no opportunity for doubt on the part of the DJ or anybody else who reads your defence.

    No attachments go with a defence; this is not evidence stage yet. Bargepole's post about what happens when, explains. The good thing is, you've done some early evidence preparation work that will make your Witness Statement/evidence stage easier!

    You also need the usual headings at the top & statement of truth & signature/date at the bottom.

    And that defence needs to be 1.5 line spaced, as it looks cluttered (maybe that's just the way it copied here). Needs separation of points.

    Do you have a ticket? If not try sending a SAR to the operator of the other machine for the payment records for that day showing your payment. It may be too vague to prove anything but it will show willingness (honesty) to a court.

    And do VCS know you mistakenly paid, and this is a "de minimis" issue. At best you owe the tariff and not the "penalty" element.

    Depending on how you want to play this, you could see if you can set them up for unreasonable costs. But you'd have to make sure that a) VCS have a copy of the ticket and b) you have invited them to drop the case to "save the burden on the court and the other court users".

    They haven't a hope in getting the amount using Beavis so just keep pressing them to drop the case.

    Yes they know all about it. It's part of their photo evidence I viewed online, proof I paid in the wrong machine. As of Saturday the photo was still online as proof against me. I will screenshot it and keep as evedence against them. How ironic. Thanks.

  • Before you go any further, have a look at claxtome's thread which is very similar. It wasn't dark, but it was a big carpark run by 2 entities (one council) where it wasn't clear at all which part was which.
