BW legal and NCP

Got a letter, well 2 in fact. One from NCP telling me they had handed my case over to BW legal and the second from BW telling me to pay or they would seek their clients instructions about taking me to court.

The car penalty relates to a trip my sons took in my car to an NCP car park in Dundee. They don't deny they used the car park but there is no way they went over the 1 hour time limit. The original letter from NCP showed them arriving and leaving, both photos time-stamped, which suggested they did. Both sons swear blind they were not there longer than 5-10 mins and I believe them as they hate shopping and only went there for 1 thing.

I have ignored letters from NCP in the belief that in Scotland these are not legally enforceable and that I would have to contact them and provide driver's name.

So looking for any advice. Can I continue to ignore this or should I pay?

Thanks

The NEWBIES FAQ sticky thread has this to say about incidents in Scotland:
Q - ''I'm in Scotland/NI, so is the advice different?''

    A -
IF THE EVENT TOOK PLACE IN SCOTLAND OR NI, WE SUGGEST YOU DO (ALWAYS!) COMPLAIN TO STORE MANAGEMENT IF YOUR PCN IS FROM A RETAIL PARK, BUT DO NOT APPEAL, UNLESS YOUR CAR IS A COMPANY/HIRE/LEASED VEHICLE, IN WHICH CASE, APPEAL AS HIRER/LESSEE (SEE * AT THE FOOT OF THIS POST).

IN SCOTLAND/NI, CERTAINLY COMPLAIN TO THE RETAILERS, BUT IGNORE THE PARKING FIRM UNLESS YOU GET A CLAIM.

IN SCOTLAND THIS IS EXCEEDINGLY RARE, AND DEFENDABLE BY A KEEPER, WHO CURRENTLY HAS A FAR MORE PROTECTED POSITION IN LAW THAN AN ADMITTED DRIVER.

WHEN IGNORING IN SCOTLAND/NI, KEEP ALL LETTERS. DO NOT THROW THEM AWAY, FOR 5 YEARS.

BW Legal are acting as debt collectors and specialise in sending out scary letters.
As long as the scummy parking company don't know the driver's details in Scotland they are stuffed.

My first thought was whether BW Legal can even operate in Scotland. Checked the Scottish Law Society register and these pop up.

Looking at their website it seems they are associated with the Leeds based BW Legal. Wonder if it means we'll be seeing them start robo-claiming in the Scottish courts?

Of course they do, but how many times south of the border have they gone to court with non-POFA compliant cases and continually tried to argue Elliot Vs Loake, invariably unsuccessfully?

That's because they are thick ..... guess the penny dropped
with them once reading the Parking Prankster and this forum.

Their latest rubbish wheeze is the £60 fake add-on
which they say is admin OR a contractual charge
Probably take months to get into their heads that
they are trying to extort money

BWLegal are simply an outdated joke
