Used car purchase from a dealer, does loss of bargain apply?

Do you never negotiate?
What are you trying to negotiate? To get the dealer to put the "cracked" wheels back on? To get the same car, for the same price, but with a set of new alloys?
The dealer has offered you the deposit back, and if you suspect foul play you're best being away with it. He's not going to negotiate with you any further, and you're not going to get any more out of him legally. Presumably you don't want the car, since there could be all sorts wrong with it and have a spiteful garage to return too. Did they just swap out the wheels or did they swap any of the internals? If the alloys are worth doing that with too, then what else would be?
How much money are you actually out here? An HPI (which I assume you got), some fuel, and a couple of hours wasted time? You're going to waste a lot more time and money extracting anything at court, and he's already made you a fair offer. Cut your losses and look for another car from a less dodgy car dealer.0 -

You could put a claim in for your losses which in reality would be probably half a tank of fuel. He can argue that the car wasn't roadworthy and he fixed it before sale. The judge will probably recognise this as a lie but you can't be sure. The judge like most members of the public will not bother what wheels are on a car as long as they are round. It's a bit like judge Rinder. You would have a good chance of looking daft with your wheel obsession. Just get your deposit back and find another used car to buy.0
