Is the PCN reference number the same as the original one? If so, write back, copy the discontinuation notice, tell them to either cease and desist (and confirm with a full apology) or issue a claim where you are 100% confident of success in court and at which you will counterclaim for punitive costs based on their client's wholly unreasonable behaviour. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Thank you once again for all your valued advice. Based on your advice, my plan of action is to report them to the Solicitors Regulation Authority, Action Fraud, the Judge at my local court as follows ...To Whom It May Concern,I am writing to bring to your attention what can be considered unscrupulous behaviour of attempting to extort monies not owed, breaching DPA 2018 (GDPR) and SRA principles, and continued harassment by BW Legal.BW Legal was acting on behalf of their client KBT Cornwall Ltd t/a Armtrac Security Services having issuing me with a Penalty Charge Notice on private land on 13th September, 2018. Having disputed the PCN, had my appeal to the client rejected, written letters of complaint to bring being the victim of the widely publicised private car park scamming practice to the attention of both the landowner and my local MP, BW Legal continued to harass me for over a year. This caused my family and I undue stress and anxiety, including taking a significant amount of my time to defend my dispute of the the PCN. In May 2019, I received a County Court Claim, and following the General Form of Judgement, which I received in September, I received a correspondence from BW Legal in October, which enclosed by way of service their client’s Notice of Discontinuance; a copy having also been filed at court.Although BW Legal had been instructed by their client to file and serve a notice of discontinuance, to my surprise, I received the attached email on the 30th March 2020, whereby BW Legal appears to be once again harassing me by attempting to extort monies not owned.Yours Sincerely,Then to respond to BW Legal's recent email as follows:To Whom It May Concern,I am writing in response to your recent email on the 30th March, 2020 and to remind you of your correspondence dated 1st October, in which you enclosed by way of service your client’s (KBT Cornwall Ltd t/a Armtrac Security Services) Notice of Discontinuance; informing me that a copy had also been filed at court.Having been instructed by your client to file and serve a notice of discontinuance, I consider your recent correspondence and behaviour to be unscrupulous in attempting to extort monies not owed, breaching DPA 2018 (GDPR) and SRA principles, and continued harassment. I am therefore informing you that this behaviour has been reported to the SRA, Action Fraud, and the Judge at my local court. Furthermore, in line with GDPR 2018 and your organisation continuing to hold personal information on me when it is no longer needed and this now being used unlawfully, I request that you erase all my personal information and confirm this in writing.Yours Sincerely,1

Parking Charge, not Penalty charge
Money not owed, not "owned"
I REQUIRE that you cease processing my data, and confirm to me within 14 days that you have done so.
I would be ssending them a LBA actually, and then sue them. Easy £500.4 -

Go Jase! I suspect I may now be in exactly the same boat. I received a similar letter although I can't know it relates to the claim they already discontinued on (wasting masses of my time in preparation for court). I have another 6 letters as yet unopened from BWL, so I will continue watching this thread and if you don't mind I may just 'borrow' some of your text regarding DPA/SRA etc as I will be complaining also. Once I can confirm fully that they did write to me again in relation to a claim they discontinued on (the day before hearing), I will definitely consider suing as nosferatu mentioned above. Watching with interest, keep us posted

As we keep on seeing with BWLegal, they are incompetent and getting worse
The rubbish they come out with to try and substantiate their fake £60 is laughable, someone in their firm is clearly employed to write such nonsense. BWL are not fit for purpose and not fit to be members of the SRA4 -
Thanks again. I thought this was dead in the water last October. The recent correspondence has just fuelled me again.
Nosf ... I am more that happy turning my response to them into a LBA. I never did submit an invoice to them for my wasted time anyway; life just took over. I assume it would be to late now. Can you direct me to some text/wording/template that would assist me turning my initial draft response into a LBA?
Didger ... absolutely not ... the more of us that fight back against this unscrupulous practice, the better. Since starting this thread, I have been directing people to this forum and insisting they challenge the PCN.
i am going to send the complaints to the SRA, Action Fraud, and the Judge today and do a little more work on drafting a LBA from my initial draft response.
Thanks again.6 -
