    Yes I sent a letter of complaint to both the land owner and my local MP. I got no response from either though!
  • Great result Jase. I see the courts do sometimes actually care about CPR!! Hope they do the same in mine! Inspiring reading this and as Deep said, now play their game and chase down payment for the time you were FORCED to put into this. Swines.

    The Judge certainly painted them into a corner with all those questions, small wonder they ran away.

    That list of questions should be a standard issue to all private parking Claimants seeking to sue through the courts. Spot on.

    Cheers Didger. Yes it was reassuring to read the court's judgement around CPR. I hope yours goes similarly well.

    As I stated early on in my thread, once I'd got the reassurance and confidence from this forum, I was going all the way. This was a matter of principle! This is not over for me.

    I think this gives great direction for me in writing my next defence to Armtrac as I have several coming my way. The Judge did a great job of listing the points for me :D - perhaps even worth adding to Newbie thread?


    Jase - Good for you, I would (and will!) be the same. If your MP didn't respond, write again, or better still, find his/her surgery times and go sit in front of them. I once did this many moons ago, I got Nick Clegg (back when he was just a lowly MP in Sheffield, actually no he was dep PM i think). It was about a large fraud in which many of the victims were his constituents. I suspected he wouldn't give a damn, he had ignored letter after letter, but I went anyway to see if a face to face might emphasise the importance to him. He gave all the signals, gave loads of promises, acted like he cared, then did sweet FA and renaged on every promise he made (to do x,y and z). I dont regret it, i made him sit and put an act just for me and took up some of his time (paid for by tax payers of course, but still!). You have to have zero expectations on an individual basis, but keep in mind that the more of us who do this, the bigger the drone in their ears becomes and eventually they feel obliged to listen, in my view anyway. One day, someone might just come across a politician that isn't cut from the same self-serving scum cloth that Armtract types are, and they go kick some PPC-Ar5e!!! :D.

    I am just putting an invoice together for my time wasted on defending this claim. Should I also hear from the court that the claimant no longer wants to pursue the claim?

    Also, is their an acceptable amount to invoice them for; I have spent a significant amount of time doing the necessary research, completing the necessary documentation, etc.

    Finally, are there any examples of cover letters to include with the invoice?

    Have a look at the link to Blue Toffee's thread where that poster claimed costs after a discontinuance, I think. It's rare to get it granted and an 'invoice' won't work unless you are prepared to file an actual claim and see it through!

    Having received a correspondence from BW Legal last October, which enclosed by way of service their client’s Notice of Discontinuance, I did not expect to be posting on this thread so soon. However, to my surprise, I received the following email from BW Legal yesterday.

    My first thought was to send it on to Action Fraud, as they trying to get monies paid to them that is not owed?
