Hi
So long story short I bought a item through a friend back in 2015 and missed payments and he issued a ccj against me which I ignored. He has since then be 're issuing ccj online and has now named my partner on them when she was never involved in the matter is this legal
Also I spoke to him recently and he said he would remove both if I pay him which I'm willing to do is this possible
Thanks

The CCJ won't be removed by paying it, but it will show as settled. He can't 'reissue' it.
It sounds as if paying it would be a good idea.0 -
He is saying he has the option to remove it. Is it legal to 're issue a ccj every year for the same debt then naming somebody not even involved in the debt.0
-
So just to clarify I have two ccj for the same debt0

If you have a CCJ (County Court Judgement), no one can remove that except exceptionally by order of the Judge
It sounds like you only have a County Court Claim.
Anyone can issue a claim against another, or others, for anything they feel they want to.
The court papers will tell you what your options are (such as defending the claim)
The complainant can withdraw the claim at any time before judgement is issued.0 -
Hi these have had a judgement the first I had knowledge off the second I had no idea and was done for the same debt a year later is this allowed two ccj same debt a year apart.
He also named my partner on the second judgement we had moved by this point, the second just seems malicious and not allowed0 -
The judgement can only be made against the person who owes the debt.
Are there any receipts or signatures for this "purchase"?
What was "purchased"?0 -
The court process goes like this.
Your friend issues proceedings against you, letter before claim, then a claim form, did you receive those ?
If you don’t respond to the claim form, you get what is known as “judgement in default “.
CCJ’s cannot be removed from your credit file unless they are either paid in full within 30 days of judgement or successfully set aside, only the court can do this, no one else, certainly not the claimant.
Looks like he’s chanced his arm and obtained judgement in your partners name too, you need legal advice on this, every enforcement stage costs the claimant more money, with no guarantee of getting anything back.
I assume no enforcement action has been taken yet.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Hi
Sorry for the late reply this all happened when I wasn't in a good place financially and I'm just getting back on my feet now.
I only knew about the first ccj and I did ignore that one. And the enforcement agent come to my address once I explained what had happened to her and she left with out enforcing crazy I know
I then moved out that property which claimant knew and blocked me on Facebook he then issued another ccj against me and my partner she had no idea until recently after a credit file report. The only evidence he has of me owing him money is over Facebook no signatures either way.
So how can my partner get her removed
I do plan on paying him over the coming months but there shouldn't be two ccj for the same debt
Thanks for your replies0 -
Hi
No signatures or receipts just a Facebook conversation between me and him it was for a graphics card back in 2015 to which the debt is 2500 -
What a waste of the court and enforcement officers time.
How did the other party manage to obtain a CCJ against you with no proof?
If that was the case then everyone could take anyone to court over nothing with no proof0
