At County Court stage

Basically I run a small garage, lent a customer a car last year while there’s was in for repair (November 2017), moves house mid 2017 and forgot to update vehicle logbooks with new address
About a month ago received a letter from BW legal about a parking notice from 22/11/17, took me a while to figure out who had which car on which day etc and totally forgot to reply with customers details as knew customer had moved and didn’t use me anymore etc.
Today received a letter from the county court business centre, am I too late to do anything about it now? I’m half inclined to pay it because quite frankly I could do without the hassle but at the same time don’t really want to pay £250 for someone else’s cockup!

    post the DATE OF ISSUE and the full POC below


    then start drafting your DEFENCE

    The claimants claim is for the sum of £248.12 being monies due from the defendant to the claimant in respect of a parcking charge notice (pcn) for a parking contravention which occurred on 22/11/17 in the private car park/land located at Ipswich Tacket Street IP4 1AU in relation to a vehicle Ford Focus Setec registration mark XXXXXXX
    The defendant was allowed 28 days from the PCN date to pay the PCN but failed to do so
    Despite demands having been made the defendant has failed to settle their outstanding liability
    The claim also includes statutory interest Persuant to section 69 of the county courts act 1984 at a rate of 8% per annum (a daily rate of £0.04 from 22/11/17 to 15/10/18 being an amount of £13.12 the claimants claim includes £60 costs as set out in the terms and conditions

    With a Claim Issue Date of 16th October, you have until Monday 5th November to do the Acknowledgement of Service, but there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox link from post #2 of the NEWBIES FAQ sticky thread.

    Having done the AoS, you then have until 4pm on Monday 19th November 2018 to file your Defence.

    A whole month. Loads of time to produce a perfect Defence, but don't leave it to the very last minute.


    When you are happy with the content, your Defence should be filed via email as described here:

    1) Print your Defence.
    2) Sign it and date it.
    3) Scan the signed document back in and save it as a pdf.
    4) Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    5) Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    6) Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
    7) Wait for your Directions Questionnaire and then re-read post #2 of the NEWBIES thread to find out exactly what to do with it.


    You would be wise to remove your vehicle's registration mark from your most recent post.
  • What is my defence? Just it wasn’t me? If they can supply times I can potentially supply proof I wasn’t there assuming I took a photo on my phone at work at the same time or something similar?
