Thanks again, I shall be using the template below. Just checking as I want to make sure I have this correct. I'm waiting till day 26 and sending the below template only (I don't need to include any other Info) through the appeal section of the TOTAL PARKING SOLUTIONS website? In the mean time I'm going to email everyone I can think of at the hospital and possibly the local MP?
I will try to get some back up through Unison contact but I may have hit a hurdle with that as I only qualified in April, and despite being a member with them through my 3 years training I was unaware that I had to 'rejoin' when qualified so have had a few months of membership lapse- not sure if that voids my use of their legal advice promise, but I shall check.
Here is the template I will email
'Re PCN number:
I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement. There will be no admissions as to who was driving and no assumptions can be drawn.
Since your PCN is a vague template, I require all photos taken, a clear image of the signage and an explanation of the allegation (e.g. if you have identified a wrong VRN input at a machine, say so, and explain why your Data Protection Officer has not simply rectified it, rather than trying to punish a driver for a matter where there is nothing to deter).
I will be making a formal complaint about your predatory conduct to your client landowner and to my MP, appraising all parties of the debate where Parliament agreed: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists...should not have to put up with this''. Firms of your ilk were unanimously condemned as operating an 'outrageous scam' (Hansard 2.2.18). The BPA & IPC were heavily criticised; hardly surprising for an industry where so-called AOS members admit to letting victims 'futilely go through the motions' of appeal and that 'we make it up most of the time' (BBC Watchdog).
Formal note:
Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service.

This is very new to me and i want to be crystal clear that i am going to use the correct wording. It is copied directly from the newbie thread, which while being very helpful is also very long with a lot of information (which has confused me somewhat), hence me preferring to seek a little reassurance. The problem with approaching these cases in a hostile manner is that you sometimes have to row back and apologise to get what you want.
Based on the facts presented, the car was dumped where it should have been and if a judge thought the signs were clear, then you'd be in for the full amount. The only defence, and it is a one-shot defence, is that the "penalty" amount wasn't clear.
Were you to repeat by parking again in the same spot, the lack of clarity couldn't be argued. There is no entitlement to park there, so there is in effect little defence apart for a lack of knowledge of what can happen.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court Hospital car parks and residential complex tickets have been especially mentioned.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently

Just send that yes. Nothing wrong with the template appeal being robust, IMHO.I have already emailed my manager and department manager and am in the process of speaking to unison -again not sure if any of this will help but its worth a go.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
