    Ah i can see now that what you guys have been telling me is to literally just use the 'one size fits all' template. And that quite likely other forms of efforts to counter or defeat the charges made by PPCs will not work. Apologies for not actually understanding this earlier.



    Happy to try the template. Was wondering though whether this applies to a situation like mine where I am currently not appealing to the PPC (which they had rejected earlier), but rather to POPLA?

    The letter says that "..you have 28 days from the date of this letter..."[this letter is the appeal rejection letter from the PPC]. The letter from the PPC is dated 06 Oct 2018. So this is possibly 2nd Nov 2018 (including the date of the letter).

    At least you're in time. You can actually squeeze about 32 days out of it - but if you can get it done by 28 days, so much the better.

    I was cleaning up my emails today and came across this issue settled last year, and thought I'd share here the points I used in successfully appealing the PCN received last autumn in case it might be useful for readers.



    I ended up not using much of the template titled "TEMPLATE ''ONE SIZE FITS ALL'' FIRST APPEAL THAT DOESN'T SAY WHO WAS DRIVING" at this site's FAQs, as I was not confident about making use of the legal points there that I didn't understand, in case I was challenged on it. But the legal approach underlying the template was useful and I focused on



    1) aspects of the PCN's noncompliance with POFA and the the BPA Approved Operator Scheme Code of Practice 2018



    and



    2) and my contention that the VRN in the PCN i) is not 'correct' as per DVLA's definitions of what a VRN is (i.e. requires a 'space') and ii) was unable to be entered in the payment machine (evidenced by an attached video (taken after the incident) of the machine's buttons not working).


    Ultimately though I was not sure at the end which aspects of this appeal was successful as the reasons for the non-challenge of the appeal was not given.


    Many thanks again for all your help and all the best to future sufferers of these ridiculous car park operator practices. May we see the end of it very soon.
