Hi folks! First post here, but done a lot of reading on this matter before i made a start.

Ok, so like many, i've had the brown envelope hit my door with the 2 letters inside.

After reading through pages of this forum (awesome BTW!), i see i need to go and find a 'template' on the 'sticky'? This has got me slightly confused, because to be honest, i actually cannot find it? If someone would be kind enough to point that out to me, i'd be very appreciative.

BTW, today is the final day of my 7 day appeal time limit, so i'm now in somewhat of a panic! lol

Thanks in advance to anyone that can spare a few minutes to help and old git out!

  • I do not believe this. Not 5 minutes ago, the postman arrived... and ANOTHER letter from Highview claiming i overstayed. This is now deeply worrying. I really must send them this 'template' so, without beating this to death, if someone could help me locate this, i'd be VERY thankful.

    Thanks, a very concerned O.a.B.
  • If you go to the top of this page you will see the following file list (breadcrumb trail):

    Main site > Forums > Household & Travel > Motoring > Parking Tickets, Fines & Parking >

If you click on Parking Tickets Fines & Parking, you will go back to the list of threads.

The third thread is entitle "NEWBIES - read this first" (or sometiing very similar)

    Click on that thread.

There are only 4 posts, (number in top right) but each post is long. Scroll down to post 1 - this is for initial appeals, as you scoll down within post 1 you will find the appeal template.

Do take the time to read all the info as it affects when you appeal, - depends on which company, and if you had a ticket on your car or not.

    Hope that helps.

Hit your back button once - it will return you to the forum's home page where all the current threads are listed.

The third thread down is headed:
**NEWBIES!! PRIVATE PARKING TICKET? OLD OR NEW? **READ THESE FAQS FIRST!** Thankyou!

That's the thread you are looking for. Then, in post #1 of that thread (every post has a sequential number in the top r/h corner of each post, this one is #4), scroll down until you see a block of text in blue typeface - that is the initial appeal template which you should use.

  • Paul... is this what you mean? Post called **NEWBIES!! PRIVATE PARKING TICKET? OLD OR NEW? **READ THESE FAQS FIRST!** Thankyou! by Coupon-mad?

And the part you must mean (i hope) is as follows?

Template appeal for BPA or IPC members - copy this wording into the online appeal box::

    Re PCN number:

    I dispute your 'parking charge'

    etc etc?

    Thank you, O.a.B.
  • Umkomaas... thank you also! I think i have the right thing now, as i mentioned to Paul? Fingers crossed because if they think i am going to be paying 1 of these things, let alone 2, they have another thing coming. Outraged.

Have you received two separate and different parking charges (check their reference numbers)?

If so, you will need to deal with each one as a separate entity and send the initial appeal template twice. No need to change the wording, just two separate appeals.

  • Umkomaas... yes that's correct. 2 different numbers. Why can they not provide a simple e-mail address instead of this appealpcn.co.uk rubbish? I digress. I will gladly submit the same 'template' on both form-fillings. Excuse the way i word things! I really am in a bit of a state here, and i'm flustered to say the least!

Now i just spotted something else that's confused me. On that submission form, we have a 'REASON' section. I suppose i had best not be rude when filling that box in, tempting though it may well be!

Anyway, i'll continue the page and see what follows!

Thank you for your help to date!

Be very careful with that drop down box for both your appeals. Its default setting is to a statement where you effectively identify yourself as the driver. You must set it to one which does not identify the driver - do that as your ver last task before submitting the appeal. If you do it earlier, then make a small amendment to what you've already written - it defaults back and to the 'i was the driver' statement.

Take screen shots of each submission just before pressing the 'Submit' button.

  • Umkomaas... oh nuts. I've already done it and sent it off. I never took a screenshot. I'll guess that i also most likely selected the wrong option. What i chose was 'I was not aware of the Terms and Conditions' so, rightly or wrongly, that's where i am. They say 'only fools rush in' so that gives you an idea of me and the state i'm in over this situation. Not good.

and slightly longer, the committee stage

    https://www.parliamentlive.tv/Event/Index/d5550515-cce9-4185-83ec-754dadb7524a

''Rip-offs from car park Cowboys must stop''; unfair treatment; signage deliberately confusing to ensure a PCN is issued; ''years of abuse by rogue parking companies''; bloodsuckers; ''the current system of regulation is hopeless, like putting Dracula in charge of the blood-bank''; extortionate fines; rogue operators; ''sense of injustice''; unfair charges and notices; wilfully misleading; signage is a deliberate act to deceive or mislead; ''confusing signs are often deliberate, to trap innocent drivers''; unreasonable; a curse; harassing; operating in a disgusting way; appeals service is no guarantee of a fair hearing; loathed; outrageous scam; dodgy practice; outrageous abuse; unscrupulous practices; ''the British Parking Association is as much use as a multi-storey car park in the Gobi desert''; and finally, by way of unanimous conclusion: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists and ordinary residents should not have to put up with this''.

These are the exact words used, so you should quote them to your MP in a complaint and ask him/her to contact Sir Greg Knight MP if he wants further information about this scam.

and some quotes from the committe stage

"The other area is hospital parking, and I want to single out one company for some pretty shady practices. That is ParkingEye"
" is very clear to me that there is collusion between parking companies and solicitors’ firms—so-called roboclaims companies. "
"They are often set up adjacently and involve the same directors and personnel. Incidentally, the same personnel get involved in the so-called appeals bodies."
"Essentially, it is a money-making enterprise that takes advantage of motorists up and down the country. They operate in a very business-like fashion, which is why I call them roboclaims companies."
"The companies are jamming up parts of our legal system."
“I now pretty much know exactly how the parking companies and in particular the IPC have been running this scam for the past 5 years. Basically both of the appeals processes are a complete and utter sham, (and part of that sham is Gladstones Solicitors itself)”
"The appeals process at Excel/VCS is run by a team of minimum wage office workers with no legal knowledge or experience whatsoever,"
" It is claimed by the head of the appeals service (retired Judge Bryn Holloway) that this is a completely independent fair process, it is not”
"The letter mentions two individuals—Will Hurley and Bryn Holloway—and concludes this is a typical example of the clear collusion between the IPC, their members and the IAS"
"what we can do about roboclaims companies and solicitors firms that profit, often in shady ways"
" the very large amounts of money that can be involved in such scams—a company called Smart Parking was involved in one such scam on my patch"
"tightening up the rules regarding the unfair use of automatic number plate recognition" "BW Legal, regularly issues 10,000 county court judgments a month, and is known to have issued 28,000 in one month"
"They are jamming up our court system, and are often totally unjustified."
" because the lifeblood of trying to extort money from people is having access to their details."
