UKPC more than most PPCs have increased their activity in 'leaving the site' charges. An additional income stream from those naive enough to pay up on receipt of NtK, or income to shore up losses on traditional PCNs as the GB motorist gets a bit more wise? Who knows.
Whichever, they seem particularly shy of POPLA finding against them on this. You can drive a veritable coach and horses through a 'leaving the site' case that I would say it's impossible for any PPC to win at POPLA.
Judge McIlwaine in Ibbotson provides a number of still applicable starters for ten.
UKPC's continued avoidance of POPLA in these cases can only help confirm the scam nature of 'leaving the site' charges.Please note, we are not a legal advice forum.
