What about 'unclear signs/no boundary showing 'the site'?

What about 'no keeper liability because they haven't sent you a NTK (or did they)?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks Coupon Mad. I did receive NTK. Is the following suitable to add to the bottom:
    3) No Site Boundary defined
The notice to keeper states that the vehicle driver left the site resulting in the driver incurring a parking charge of £100.

No explanation has been provided as to what constitutes leaving ‘the site’ and it has not been established whether the driver was on site all along. The only evidence provided are pictures of a car parked within a parking bay.

If no such sign or evidence exists, then I contend that the driver could not have known where the car park site boundary began and ended and in the absence of proof, I deny that there was any contravention. As a result, there was no contract formed with the driver to pay a charge in 'exchange' for going off-site; there was no consideration, offer or acceptance and no site boundary defined.
  • Hi, I'm at exactly the same stage as you when you first posted, could you clarify that you ignored sending a second appeal and waited for a Popla code?

Sorry if that's a stupid question but I've read so many post's here and on other sites that I was convinced I should respond and now after reading this post I don't think I should.
    Many thanks

What about unfair terms and conditions in consumer contracts? What about the Human Rights Act? At least one MP thinks this T&C is a no no.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. It has even been suggested that some of these companies have links with organised crime.

Watch the video of the Second Reading and committee stage in the House of Commons recently. MPs have a very low opinion of this industry.

and complain in the most robust terms to your MP. With a fair wind they will be out of business in the not too distant future.

It's not confusing. Why would anyone think they have to reply to UKPC's tiresome, same old template begging letter asking for 'more info'? it even TELLS YOU that a POPLA code will follow!
In response they’ve asked for evidence that I (“you”) used the onsite facilites, and given me a deadline of 2 weeks from the 11th. I recieved their letter yesterday so not sure which carrier pigeon they used. They also offered me a reduced rate to pay the ticket and stated that if I don’t, I’ll receive a POPLA code.

  • Thanks Coupon-Mad
Just wanted someone to confirm it, I think I have read too much and got confused, I'm doing this on behalf of my 18 year old daughter who just wants to pay and be done with it and I really don't want this scumbag company to get away with yet another easy payout.

I have sent another email to JLL tonight in the (naive) hope they might do something to help cancel the ticket, if not I will continue with the process given in the "newbie" guidelines.

Once again, thank you so much for taking the time to assist.
    kind regards
    G.

Glad you are stopping your kids from paying these scams.

My adult kids are taught the same; it's an important life lesson to be a bit cynical and canny, and spot a scam. And never give up just because a person or company is bullying you.

    :)

  • Absolutley, couldn't agree more, it's quite daunting actually and I have to confess I thought myself it might be easier to just pay but that's what they prey on and I am not going to let them get away with it.

I have also sent off letters to my MP and am trying my best to follow all the fantastic advice on this site but I have definatley found myself in the situation of information overload, hence the post.

It's been quite an "eye opener" at just how disgusting this "industry" is and clearly such a lucrative market (scam).

It's quite scary to think how many people have just "paid" these parasites due to the intimidating nature of the correspondence one receives.

Have you seen Andrew Gogun's thread at the top right now? A PPC is following his posts and rang him up.

Bullying in the extreme, for using a forum.

    Nasty industry.

  • Just got this from POPLA:
UK Parking Control Ltd have told us they do not wish to contest the Appeal. This means that your Appeal is successful and you do not need to pay the parking charge.

I wanted to say thanks to everyone that helped with this ticket.
