sangie595, we're contracted for two banking firms but we don't get paid by them, just the call centre I'm employed for.

So what is the agency that you mentioned?

It sounds like the OP is employed by a call centre which acts as an outsourced 'agency' for other organisations (in his case, the banking industry). So I think he is indeed employed by the organisation, and is using the term 'agency' to refer to his company, and therefore not working for a recruitment agency.
' <-- See that? It's called an apostrophe. It does not mean "hey, look out, here comes an S".

Out of all this confusion one thing is clear. OP, once you get another job (or if you survive in this one) you need to join a union because you don't really have much of a clue! That's not a criticism, just an observation!

I think that the answers at this point are possibly moot, but is it possible that you aren't an employee then? It's gets quite complicated, but commission based payment.... describing this as an agency ( in some circumstances "employers" can actually own their own agency and that changes the legal status of some things).... I'm wondering if you are a worker. Which is different to an employee, has far fewer rights and is also not legally entitled to union representation (which is a right for employees).
