  • Anyone can land up in a disciplinary and sometimes it doesn't have to mean worst case. Don't let it get you down. In the call centre I am in for instance three separate sickness in a 6 month period can get you at risk of a disciplinary, they have to mention it when they do the return to work form and that wasn't no bad thing - again just another process, but that actually works for someone as one of the questions on the form asks if you are having any home or work problems the employer should be aware of. (The person has only been in their job 6 weeks and the sick day probably helped them not do something totally stupid in the end, so it's far from the less 2 years and you are immediately out the door). Would you let me know which Union you go with.

    Hope things get better. Much tougher than me is my mate who is a job fighter - they managed to rack up 25 months in their former call centre.

    I did see about taking a union representive in an disciplinary meeting, if the result turns out that way and work said it wasn't allowed. I don't know whether this is standard practice.

    On the other hand, I am getting anxious and stressed about what my future holds for this company - though I am working on an commission based income for an agency, so my future probably isn't bright.

    Im just anxious and stressed though because I move in to my new flat as of next week and don't want to be jobless down the line.

    If it is a disciplinary meeting which could eventually lead to dismissal you can be accompanied by a Union official if you want.

    Joining a TU now won't get you an official to attend a disciplinary where the situation has already arisen. Do you know anyone who happens to be a Union official who would be willing to attend? (You don't have to be a member of their Union if they themselves are willing to accompany you - say if they are a friend. They would be attending as a Union person, not your friend.

    I don't know anyone on a personal level that is a part of a union, no. So I'm rather stuck. :(

    Sounds like some miscommunication. I'd say check directly with the team leader about future overtime rather than colleagues so you don't have your time wasted again.
    Re the data breach, it has to be taken seriously. The penalty for breaching GDPR ( If it was related to that) is really high. A company could literally be fined millions so they have to show they are taking things seriously. That doesn't mean you will certainly be fired. Depends on your intentions. We're you cutting corners or was it a genuine mistake? If I were in your situation id show that I'm also taking it seriously. Apologize and be willing to take any training that's offered. Don't argue or be defensive. do highlight if you were given incorrect into though. As others say, you can take a colleague with you to a disciplinary meeting. Neither you or the person accompanying you has to be a union member.

No. If it is a disciplinary or grievance hearing, you are entitled to be accompanied by a trade union official or work colleague. Dismissal has nothing to do with that right.

They must be accredited for these purposes. Any old union official won't do. Not all union officials are accredited for representation. .

    I am confused - but also maybe not on second thoughts.. Actually I think they might have told you that you can't be represented. If I read that last post from the OP correctly then this isn't a disciplinary meeting in law. The company isn't the employer. They can't therefore discipline or dismiss them - they simply tell the agency they don't want them. If I'm correct then absolutely everything we told the OP is moot - the company doesn't employ them and can dispense with their services with one phone call whenever they want.

    That then also answers the overtime question. The company does not allocate overtime, the agency does. The OPs contract is with the agency (if they have a contract at all), and any issues they have need to be taken up with the agency that places them.

    OP, you need to tell us who you actually work for!

    Please delete that post, or at least the names of the companies involved. Golden rule - never put identifiable information about your employer up on line. Otherwise you tend to get into strife for bringing them into disrepute.

    Are you employed by the call centre, by an agency, or something else.
    All shall be well, and all shall be well, and all manner of things shall be well.
