The OP isn't asking about the employers perspective, she's asking whether they are legitimately able to say "apply or lose the redundancy" and checking whether the new roles are likely to constitute suitable alternative employment.

Excellent. Except that the employers perspective is the only one that truly matters.


They can refuse to pay redundancy and the onus is on the OP to then take action.
