Hi all.
New here and first post. I have searched this forum and online for ages and I have a little understanding but I am totally stuck on my next steps and what to do. if I am not meant to start this thread or am asking questions that has been spoken about already my apologies.
I have been ignoring fines sent to me for a long time now under the assumption ignoring them works and they will go away. It all started when I was in a petrol station in my car waiting for a friend to go to the gym. Was only there a few minutes. Got a fine in the post a few weeks later which I couldn't believe as the person a) didn't approach my vehicle and slyly took a photo and b) never even issued a ticket, stuck it on my screen or gave it to me knowing full well I was in the car. Since then I must have read an old thread and ignored them which I know believe isn't correct according to what I have read on recent threads.
The matter I am discussing today is totally separate. I was inside a gated residential home on a double or single (I cant quite remember) parked on the pavement not in any bay and in anyway disturbing anyone or blocking anyone. I was on my lunch break and as I new the gate main gate was broken as I drive past there nearly daily I drove in, sat in the back seat as I usually do on my break with my feet stretched eating my food. I came out of the vehicle to go to the front and the cheeky guy from parking control management had stuck a ticket on my window. I hadn't even been there 30 minutes and if I remember correctly it was cold and I had my car running heating on.
I threw away the ticket expecting them to harass then eventually leave me alone. There was no clear signage and it was private land and I would have probably parked on the main road but usually in that area it is always full up.
I didn't receive one letter from these guys asking from money as I would remember and the other day I got this letter from Northampton County Court. It did stress me out a little but after watching the videos and doing some research I believe if dealt with correctly it will go away.
I am totally stuck on my next steps and if its okay with you guys could you guide me through all the steps I have to take and maybe how to put a defence together and what to say and where to send it to. The vehicle is owned by my sister and the CCJ came in her name so that's troubling me a little on getting her grief and how to go about it saying I was the driver at the time.
I will post the photo minus name and address at the bottom of this post.
So far if I am correct I have to register on the Northampton CCJ site and somehow acknowledge I have received the CCJ.. Then during a grace time I have time to make up my defence and send it off. If this isn't correct what do I do? If it is would it be okay to give me specifics on how to and what to write and where to?
I know tis may have come up a million times and may even frustrate you but I really have tried so hard, to the point its getting me a little stressed. Not so much about the CCJ itself but how to go about doing it and what to write and what order to write it in and who to send it to.
These guys really wind me up. I used to get clamped by them (if they are the same people who cant clamp no more) at work, on a petrol station etc. Only a month ago I went into a shell and bought a voucher for the self hand car wash and the guy at the till told me to be careful and not park for more than twenty minutes as they will give me a ticket. I told him no worries as all I am doing is waiting for the lady in front of me to finish then I will drive in and wash my car. She left within 2/3 minutes, I drove in washed my car and left. Only to receive a ticket a few weeks or so later. This is so bad and these guys are crooks.
Please can someone guide me step by step on what to do next. It would be much appreciated.
Many thanks in advance.
Been trying to add a photo but it says as a new user I cant post a link to stop spammers so I will type out in brief what it says:
It has claimant details (parking control management) top left box. Below that in another box address for sending documents which is Gladstones Solicitors details. Below that in another box it reads: Defendant. Particular of claim. The driver of the vehicle registration ******* (the vehicle) incurred the parking charge/s on the 2*/02/2018 for breaching the terms of parking on the land at (folwed by the address). The defendant was driving the vehicle and/or is the keeper of the vehicle. AND THE CLAIMANT CLAIMS £160 for parking charges/damages and indemnity costs if applicable, together with interest of £6.88 pursuant to s69 of the county courts act 1984 at 8% pa, continuing to judgement at 0.04 per day.
The rest on the right hand side has the claim number, issue date and at the bottom the full amount of £241.88.
Hope this helps you help me.
One last thing could you please send me a link of what to do in case I ever got a letter again for parking on private land. What to do, what to say, who to write to etc. Both my brothers have been hit with the letters asking for payment from these guys for over staying their time at a private car park after using the tennis facilities.
Many thanks.

Have you really received a County Court Judgment (CCJ), or have you received a Claim Form from the County Court Business Centre in Northampton?
Terminology is important if you want the correct advice, and you haven't received a 'fine.
Assuming you have received a Claim Form, can you please post the Date of Issue of that Claim Form.
Please also post the full contents of the Particulars of Claim box on that Claim Form.0 -
Hi.
Thanks for getting back to me. It is a claim form from Northampton business centre issue date 04 October 2018.
Many thanks.0 -

Is it normal for you to go onto land without invite and park at your leisure? For example, if no one was using a hotel room or a garden would you do the same?
As regards the "cheeky guy" who does that term relate to?

[STRIKE]@ Seb7. please start a new thread with your query, thank you[/STRIKE] (dealt with by Soolin - thank you)
@ Az1977
whilst you may have understood some of the court steps, you have made a few basic errors
it is not a "fine", it is a Parking Charge Notice, ( PCN ) or INVOICE
and this court claim , is an MCOL, not a CCJ
a CCJ has already been to court and a judge has ruled against the defendant, none of that has happened yet, so NOT a CCJ until after it has been to court
SECONDLY, , PLEASE READ THIS CAREFULLY
this has nothing to do with you
YOU are NOT the defendant , your SISTER is the defendant
so your SISTER has to create a government gateway ID and do the AOS in HER OWN NAME
she is the one being taken to court, not you
it is too late to name you as driver, this could have been done anytime up until the MCOL arrived at her house. the original PCN would have told her she could name the driver, she failed to do so
so to be clear, you being the driver is no longer relevant, as SHE is being taken to court, in her own name, as KEEPER of the vehicle
in future, stick to public roads where parking is allowed, stay off private parking areas where you run the risk of these charges, otherwise you (or your sister) will get more of them
tell her to READ the NEWBIES FAQ sticky thread near the top of this forum, read post #2 for advice on dealing with court claims
as for your own advice for the future , post #1 of that same thread tells YOU what needs to be done and even has a template letter for you to use (or for your sister if it is her vehicle)
also tell your BROTHERS to read that NEWBIES FAQ sticky thread as well, its the same advice for everybody who comes here , newbies or regular, you all need to read it (usually several times until it sinks in)
so DO NOT DO THIS IN YOUR OWN NAME, your sister must do this as she is the one being taken to court, not you0 -
...issue date 04 October 2018.
Having done the AoS, you then have until 4pm on Tuesday 6th November 2018 to file your Defence.
Loads of time to produce a perfect Defence, but don't leave it to the very last minute.
When you are happy with the content, your Defence should be filed via email as described here:
1) Print your Defence.
2) Sign it and date it.
3) Scan the signed document back in and save it as a pdf.
4) Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
5) Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
6) Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
7) Wait for your Directions Questionnaire and then re-read post #2 of the NEWBIES thread to find out exactly what to do with it.0 -
I have been ignoring fines sent to me for a long time
Never ignore a fine, you could end up in very deep dodo. However invoices from private companies for alleged breaches of contracts are not fines.
You seem to have dropped your sister right in it. In view of you blatant disregard for private property I would offer Gladstones £200, pointing out that they are unlikely to get more than that, even if they were to win the claim. If they refuse, save her the bother of going to court, pay them in full. You never know how far you can go until you go too far.0
