  • Apologies for my absence from this thread, I got called away on a last minute work project and only got home last night.

    As mentioned above, I only discovered this forum recently and proceedings are well underway. The mediation process took place today, so I thought I would share my experience...

    On receiving the phone call from the mediator, they explained how the process works and that the claimant was willing to try reach a settlement, I also indicated I was willing to try reach settlement.
    Initially, CEL offered to reduce the fee to £265.00, I declined this and offered to pay the original demand for £60.00, they refused my offer.
    In return, they offered to further reduce the fee to £225.00, I replied that I would be willing to pay the £225.00 provided CEL would issue in writing, a full explanation of why I had received 7 PCNs; CEL refused to provide a written explanation stating that they would incur further costs doing so, but did reduce the fee again to £185.00. I replied, stating that I would agree to pay this amount in instalments and that I would be happy to set up a standing order to start the repayments immediately. I was asked how much I would be willing to pay and stated I could pay £5.00 per month to clear the fee. CEL responded, stating they would only accept cheques or telephone payments and refused my offer of payment via monthly Direct Debit/Standing Order. At this point I declined further pursuing a settlement via the mediation service. The case will now be forwarded to the court.

    Not sure if any of the above helps or not, but I feel oddly ambivalent about the whole thing now that CEL have refused to accept my money.

    My understanding is that a PCN is an invoice for services, I made use of the car park in question as it was a free car park and was therefore not expecting to receive or be charged for any services.

    The notice refers to the fact the vehicle was not registered in accordance with terms displayed, neither my wife or myself were aware of such conditions or how we should go about registering the vehicle.

    On a recent visit to the same car park, I noticed that there had been a considerable investment in a large quantity of large Hi Visibility signage explaining the terms and processes, these were not in place in September 2017.

    In other news, I spoke with the manager of the supermarket (the owner of the car park) and I am pleased to hear that due to overwhelming customer dissatisfaction the system is shortly being replaced.

    Can you get that in writing and you can use it in your Witness Statement. CEL will drop this one if they see that for the simple reason they don't want judges to see it and talk amongst themselves.

    Parking companies appear to think judges don't have memories.
