Multiple PCN from CEL

Hi

I received Seven (7) PCNs from CEL through the post for the the same alleged parking infringement.

The Car Park in question is Free to use upto a max of 4 hours, I stayed between 19.33 & 22.52.

I did NOT enter my registration number in accordance with the T&Cs as I was unaware I had to do this and did not see the signage.

This all happened over a year ago and I chose to ignore all correspondence from CEL and their increasingly hysterical solicitors.

I subsequently received a County Court Claim.

I have accepted Mediation, but on just discovering this forum, feel that this is probably a waste of time.

Would be interested to hear any comments/advice from this forum.

    Mediation goes like this.

    You want to pay nowt.
    PPC wants you to pay lots.
    Impasse.
    End of mediation.
    On to court.

    Complain to your MP about this unregulated scam.

    Thanks for speedy response.
    I did call the landowner (a supermarket chain) and managed to speak directly with the manager.
    He, quote "hated the bl@&*dy system and wished he could take it away"... he offered to remove my incident from the system, but the maverick in me said no... (now regretting that little moment of bravado), I had an idea that the postage costs would hit CEL hard if they had to keep sending 7 copies of everything.

    I am assuming that a request for £236.00 is unreasonable for staying 3.5 hours in a free car park...

    Will digest the Newbie post.

    What is the Date of Issue on your Claim Form?

    Can you please post the exact content of the Particulars of Claim box on your Claim Form?

    Claim for monies relating to a Parking Charge for parking in a private car park managed by the Claimant in breach of the terms + conditions (T&Cs). Drivers are allowed to park in accordance with T&Cs of use. ANPR cameras and/or manual patrols are used to monitor vehicles entering & exiting the site. Debt + damages claimed the sum of 236.00.
    Violation date 22-09-2017<<<

    They have the reg number already as camera on the entry exit point has recorded it....

    Surely it is sometime in September or October?

    I'm asking for the contents of the Issue Date box on the Claim Form.

    Or have you already filed a Defence?

    Perhaps you opted for mediation on your Directions Questionnaire?

    What exactly have you done since receiving the Claim Form from the County Court Business Centre?

    nope , never assume, not since BARRY BEAVIS lost in 3 courts to 10 out of 11 judges, the last one being the Supreme Court 2 years ago

    that argument is likely to die as soon as it is uttered, the claimant will just say "BEAVIS YOUR HONOUR"

    you need to look at proper legal arguments that havent died a death at the S.C.

    To clarify, I have opted for mediation, as I stated in my original post. This is due to take place on Monday 15th Oct. I only came across this forum today 10 Oct, so just trying to catch up.
    I have probably missed my boat with this as it seem that mediation is probably a waste of time....

    Redx, you are correct, never assume, I assumed that being flippant with this would make it go away, alas it has not. Although I still do feel that £236.00 is an unreasonable amount...

  • The issue date shown on the claim form I have is 03 July 2018, I can not see another issue date...

    I submitted a defense stating that both my wife and myself failed to notice the signage that gave details of what we were meant to do.

    On receiving the claim form, I replied with the above defense, i was then offered the chance to go for mediation, this I accepted. I finally got an email yesterday saying that mediation was possible and would be taking place on Monday 15th, I had pretty much forgotten about the whole thing as the last correspondence was in early July.

    Reading through various posts, it would seem that the mediation process is hardly worth it, the agent at the Small Claims Mediation service implied that CEL are one of the biggest users...

    so at mediation you offer a "drop hands offer", where you offer nothing and they go away


    on the assumption that no agreement is reached, it then goes forward as if mediation hadnt happened

    nobody here is saying that £236 is reasonable, we too believe it is unreasonable, BUT there are laws and rulings and it doesnt matter if we believe its "unreasonable" (and a typical loss is £175 where £75 is court fees etc)

    what matters is what a judge thinks, in court

    so if you do not wish to offer anything at mediation, then offer nothing at all

    however, because you have not had help from here with the already submitted defence, then I am worried that its a very poor defence, so I suggest you post the defence draft here so it can be seen, along with the full POC too

    ps:- there is no s in defence !!
