Hi, could someone please advise if it is worth going to the POPLPA stage to appeal against my fine. My mother was in an accident on the Army and Navy roundabout in Chelmsford, Essex. She called me and I rushed to see if she was OK and to take her home, I could see her car on the roundabout and the nearest parking was off to the next exit. I pulled up in the car park and looked over and saw a sign saying Free 30 minutes parking, did not notice the rest of the words that I know says with a printed ticket. I was rushing with two small children one I was carrying, my fine letter states I was parked 17 minutes. I have photos of my mums smashed car with the AA in attendance, time stamped during my parking time. I have appealed and Britannia Parking have stated that the car park has clear visible signage and to be fair it has, however; this was a very stressful time and I did not even notice the bit about getting a ticket for free 30 minutes parking. I have to pay £60 now or if I go to the POPLA I have to pay £100 which is the full fine, help/advise please.

none of the story above is any use in your saga, whilst it is regrettable that an accident happened, it was not in the car park in question and the vehicle had no legal right to be there
ie:- a public road should have been used, where parking is permitted
so having said that, popla will only rule on legal arguments anyway, these are explained in the NEWBIES FAQ sticky thread, post #3 , please study it
was the driver outed in the initial appeal ?
did the NTK arrive in the post by day 15 following the incident ?
how can anyone advise you when you have put nothing about these legal matters, but a long story of what happened near that car park
I have sympathy for your plight on the day, but its got nothing to do with Britannia or the landowner as they are not involved and not liable
it is the story of events that led to this parking period that wasnt allowed by the landowner , the signage , or Britannia
unfortunate yes, but somebody had to tell you
popla will not want to hear about the saga or care about the saga, just legal arguments0 -

Firstly, you have to lose at PoPLA.
But even that doesn't mean you have to pay anything.
You do not owe anyone anything until a judge tells you to pay them.
In other words, you have to lose a court case before any need to pay anything.
Perhaps you now need to direct your efforts towards winning at PoPLA.

This should give you an idea of your chances of even attending a court hearing:
