Premier Park, POPLA stage next

Good evening :)
I appealed a PCN from Premier Park because my husband picked me and our child up from the front of the retailer. You can see my reasons below. I'm not sure their response even addresses any of my points. Did I get it wrong?

Your Appeal - Please include any supporting information:*: You issued me with a parking ticket on xx-xx-2018 but I believe it was unfairly issued. I decline your invitation to name the driver, which is not required of me as the keeper of the vehicle. I will not be paying your demand for payment for the following reasons:

• The alleged contravention did not occur The vehicle was not parked inappropriately at the time the ticket was issued. This is due to the fact that the car was not parked in one bay for the duration stated. Parking assumes occupying one bay and leaving the car.
The vehicle was driven to xxxxx, turned around and waited for family to get into the car. Being disabled, this meant that we needed to be close to the venue for safety reasons but as the car was not parked in a bay and left locked and unattended, it does not warrant a parking charge notice. Please see attached your photographic evidence of people within the car and the car in a different position in both pictures as proof of my claim.
• The vehicle was not parked on the land in question You issued a ticket for supposedly breaking your parking restrictions yet the vehicle was actually not parked meaning you had no authority to issue a ticket. Please see attached evidence of your photo as proof.
• Mitigating circumstances
There are mitigating circumstances to explain why the vehicle was waiting where it was and the charge should be waived for this reason. Please see attached evidence of Disability Living Allowance as proof of claim.
• The charge is disproportionate and not commercially justifiable The amount you have charged is not based upon any commercially justifiable loss to your company or the landowner. We were paying customers of xxxxx.

In my case, the charge you are asking for far exceeds the cost to the landowner. I therefore feel the charge you have asked for is excessive.

If you choose to pursue me please be aware that I will not enter into any correspondence and this will be the only letter you will receive from me until you answer the specific points raised in my letter.


Their response:
Thank you for your appeal, on behalf of the driver, against the above Parking Charge Notice (PCN). We have carefully considered your appeal, however on this occasion the appeal has been rejected for the following reason;

No record of a payment or permit could be found for your vehicle registration

You have now reached the end of our internal appeals procedure and therefore you now have two options;

Send a postal order: Premier Park Ltd, PO Box 624, Exeter, EX1 9JG

You can appeal to an Independent Appeals Service, POPLA (Parking on Private Land Appeals) using the POPLA reference code provided above. Please note, should you decide to appeal to POPLA and your appeal is subsequently rejected or you withdraw your appeal, the option to pay a discounted amount will no longer be available and the full amount of the PCN will become due.

If you decide to appeal to POPLA, you will need to visit their website, https://www.popla.co.uk where further details of how to appeal (either online or by downloading the relevant forms) can be found. If you are unable to access their website, please call us for further information on how to obtain the forms. Please ensure your POPLA Reference Number, as noted above, is quoted on all correspondence to POPLA. You have 28 days from the date of this letter to submit an appeal to POPLA. If you appeal to POPLA we will suspend recovery activity on the PCN and the charge will not increase until the appeal has been determined.

By law we are also required to inform you that Ombudsman Services (https://www.ombudsman-services. org/) provides an alternative dispute resolution service that would be competent to deal with your appeal. However, we have not chosen to participate in their alternative dispute resolution service. As such should you wish to appeal then you must do so to POPLA, as explained above.

If you do not make payment or submit an appeal to POPLA within the relevant timeframe, the outstanding PCN may be passed to our appointed debt collection agency for further action. All costs associated with this process will be added to the amount outstanding.

IMPORTANT INFORMATION
Unless any additional relevant information or facts are provided, Premier Park Ltd considers this to be their final decision regarding this appeal.
Please note that all payments are subject to a 50p administration charge.

    It really doesn't matter what you write in your initial appeal to the PPC. It would almost certainly have been rejected whatever you wrote.

    You now need to prepare a PoPLA appeal and to start the ball rolling in that direction, can I suggest that you have a read of post #3 of the NEWBIES FAQ sticky thread?

    Have you complained to the retailer yet, or the retail pak management? That should be done before submitting a PoPLA appeal.
