  • 4 weeks each year but it says failure to notify will be overpayment
  • Because they causing me trouble due to an argument that ensued due to her fault. But had I gone abroad I didn't exceed 4 weeks a year. My issue is the failure to notify will be treated as overpayment. Anyone know??

    Where have you read that failure to notify is an overpayment?

    You were still entitled to the money while you were away, so there is no overpayment. An overpayment suggests you got money that you shouldn't have.
    Unless I say otherwise 'you' means the general you not you specifically.

    Because I was thinking of taking my words back and not admitting to even the 4 weeks abroad because the investigation got closed because the bank statements didn't prove how long I was abroad for as they only showed transactions of flights
    But the compliance officer said she could re open the case even if her visit was not under caution. Maybe she was just trying to scare me to admit. Maybe the case can't be opened unless I admit to the flights. Not sure.

    The statements show flights throughout the year.. Some where mine some were my boyfriend as we used my card to pay . But if I admit to 4 weeks a year I am worried that admitting may allow the law to reopen the case. Whilst if I don't admit maybe they won't be able to reopen the case. Investigators closed it. Compliance officer tried to get me to admit to some stating she could reopen the case
    She wants me tell her approx which are my flights and which are his so she can send to the overpayment decision department. Whereas if I don't admit to nothing maybe she can't send anything to the decision department? Because the investigation was closed anyway? And sent to her...
    If I say they aren't mine what can they do? They won't have anything to send to the overpayment decision department right? Or can they decide themselves based only on bank transactions?

    I rather avoid the hassle you see as it's stressing me

    Because the investigator DWP closed the case as insufficient evidence was found maybe she can't reopen. It not sure

    None of that applies to going on holiday for up to 4 weeks.
  • It also says on DWP website to notify us of any change of circumstances. I've recently been told that includes notifying them
