I get what you are saying and I have looked into this a lot on line the point is I have been informed by six different people I inherited this and it is also stated in the terms of my tenancy that I have the preserved right to buy and have been given it once from this mutual exchange of which I am obtaining paperwork back for and the Housing advised that they are fully aware of.
I understand also that people don't like right to buy as it takes houses away from the social housing needs however this is irrelevant.
You are advising that it cannot be inherited , I have found several articles in regards to mutual exchange which advise it can as the exchange is a exchange of tenancy and the other person merely steps into the other persons shoes gaining All rights of their tenancy.
It is in effect an assignment of tenancy which is what is also done when someone passes their tenancy to a family member - which then passes the right to buy on to them.
All of this would be fair enough had I never been told I had this and it had not once been granted.
On my own tenancy I should have the right to acquire however at the moment they are not advising what I flipping well have0 -

I am unable to post links it tells me I am not allowed as I am new to avoid spamming up threads.
I have no problem what so ever in not inheriting this had I never ever been told I had and had I not been already granted this once. From what I have read up on on line it advises that the tenancy and right to buy remains with the property there is simply a change of name on the tenancy.
The tenancy continues then as though nothing has taken place.
These are not my rules these are on any links to mutual exchange that are on line.
I have also read up on the law changes in regards to mutual exchange which advises that if the tenancy was given prior to 01/04/2012 then the tenancy is surrendered and a new tenancy issued however this happened before all of that.
I was mainly trying to see if anyone on here had had a similar experience and if they could give any advice. I have 9 years of my own council tenancy however there is no such thing as RTB now it is Right to Acquire with a discount of 9 K regardless of years providing it has been more than three years.0 -

I have worded it wrong, it was not a new tenancy it was the same tenancy re-printed off with a name removed from it,

On getting this I also confirmed with the housing officer and the tenancy lady that the Right to buy status was not affected by this she confirmed that it was the same tenancy however all of the rights on it belonged solely to myself now.0 -

However my discount was transferred from my previous property and as such my previous tenancy where I had lived for two years.
The lady I exchanged with did not pass me her right to buy discount when we exchanged as this was not an option. Only my years of tenancy counted towards the discount.0 -

However my discount was transferred from my previous property and as such my previous tenancy where I had lived for two years.
The lady I exchanged with did not pass me her right to buy discount when we exchanged as this was not an option. Only my years of tenancy counted towards the discount.
The property you transferred from.
1 Did you have a secure tenancy or an assured one?
2 Did you transfer from a council owned property to another council owned property or was the original property owned by a housing association?
I think there may be a difference you see if you transfer from a housing association property to a now owned housing association property that used to be a council owned property. Meaning that you have never actually had a tenancy of a council owned property only of a housing association property.0 -
Perhaps then this is one of the other people that have been Misled so to speak.Oddly there was another thread started about this kind of thing yesterday.
If in effect in the end it turns out that I have been misled to this effect - if the one housing association I am dealing with has had three of these issues already in one week I should imagine there will be plenty more threads also0 -

I would be happy to maintain the discount that I have myself of 9 years - on the exchange that I did we were advised that the only difference between exchanges as this was a three way exchange was that the lady whos property I was moving into would lose her right to buy status and discount as we would inherit it as the tenancy remains with the property not the tenant. If I had just been advised this and never actually executed the right to buy and been granted it I would happily accept that I had been misled on this instance however this was granted to me 4 years ago on these terms that I had inherited this from the house exchange.
It also states it in my tenancy.
