Can anyone offer any advice . I completed a mutual exchange in approximately 2011 and was advised at the time by the landlord that the tenancy stays with the property as it is an assignment of tenancy so I inherited the preserved right to buy and discount from the lady I swapped with. Four years ago I applied for this and was granted it no issues however was put into redundancy consultation around the same time so didn’t proceed . I have now spent the last four years saving and doing work to this house with intention of buying and have just reapplied for this and it has been refused on the grounds that I have been misled and never inherited this despite the fact I have been granted it already once and it states that I have preserved right to buy in my tenancy agreement !!

speak to shelter/CAB to get a better understanding. there should still be a PRTB, but in 2012 there were a lot of changes to secure tenancies past that date. as you said you exchanged in 2011, the deed of assignment will state what part of the tenancies are excluded/inherited etc
you didnt sign for whatever reason a new tenancy after Arpil 2012? only ask this as I have known some Housing Associations do this is the past

The property may be available through preserved rtb but you cannot inherit the rtb and certainly not the discount. You may be able to buy the property based on your occupancy.Can anyone offer any advice . No the only tenancy I have is the one given at the time of swap and that was only a draft I took my partner off the tenancy in May of this year and have been given the tenancy in my own name which is still the new tenancy and still states it is protected by the tenants charter and still states I have the preserved right to buy in it . The problem I am having is they are claiming I was misinformed and have never had this ever so how the hell did it go through four years ago then ? I have read up on the changes that occurred in April 2012 however my swap definitely was prior to that and since then I have never been issued a different or new tenancy . I find it difficult to believe all of these people have misinformed me plus I have managed to be granted this once already yet have been misled0

No definitely Misled as I have submitted right to buy once in 2014 through inheriting it this way and been granted it there were six witnesses when I was originally informed of this also and my tenancy states it so no definitely have not misunderstood as the lady who’s right to buy it was was not best pleased at the time0

Also to add the lady I spoke to in regards to this also advised I have been misled as she has three other people in the same boat as me at the moment who have also previously had this go through and been told the same as I have on mutual exchange0

No not at all it was not a new tenancy it was the same tenancy with only my name on apologies if I have worded that incorrectly the tenancy is the same however his name was removed from it is all . It isn’t a new tenancy so to speak . I also confirmed at this time that this right to buy would not be affected by this with both the Housing officer and the lady that removed my partners name from the tenancy. A new copy was printed out with only my name on not a new tenancy issued is what I meant0

Which is what I have done so far, I was just wondering after being advised by the lady that deals with RTB that she has had three cases the same as this this week and we have all been misled if anyone had had a similar experience. Its all well and good never trust a newbie with a RTB tale, initially when I was told this I didn't believe it nor did I think it correct hence why I applied for right to buy in 2014 however when this is then accepted and goes through and you are offered the property at the RTB discount and it is confirmed for you several times by the staff then who am I to tell them how to work the terms of mutual exchange. The point being I have spent four years now saving a deposit as I have been misled to get a mortgage on the property and buy. I wouldn't waste my time with a tale I was merely looking for advice.0
