parking ticket on public road

Hi!
Hopefully I will get some advice here. I am in strange situation right now and very annoyed tbh.
I was issued a parking ticket whilst parking on a public road. The private landlord which is an indian restaurant is now claiming that the whole road belongs to them, and sent me the parking ticket through the agency. We have already done some research and found out the following:
The agency issuing ticket is registered with BPA. We also checked the council website for the landregistry and that part where I have parked that day does not belong to the restaurant but belongs to the council. We have contacted and appealed the ticket asking the agency to clarify why are they issuing the ticket on a public road saying it is a private land and the reply we got from them was unclear - they ignored the whole landregistry point and insisted that we have to pay the ticket.

Now that is where it is getting even more annoying. I, obviously, did not park there since then. But I did park on the other side of the road only to find out that the restaurant left a note on my car asking not to park here either? I do understand it is because they have customers and it becomes busy so they want to keep the whole PUBLIC road to themselves but is that even legal? So the question is how can I take that further and whom should I contact? :) Many Thanks for reading the whole story and getting to the end x

    1) Which parking company? The approach taken next will require more care dpeending on which company we're talking about here

    I would suggest calling the council and asking for a copy of the definitive map, showing that the road is maintained at public expense. While ther you can also ask if the council has engaged "parking company" to patrol the road, and do they get the revenue from any parking charges issued? They will not have done, and will certainly NOT get any money, so this should prompt them to tell the restarant owner to FRO!

    Of course the parking company ignored what you said. They dont care. They want money.

    2) You oculd send acease and deisst to the restaurant owner, pointing out the road is maintained at public expense, here is the Terrier exceprt confirming this, nd that their misuse of your data and harassment is unlawful. If they do not cease making these demands you will issue them an injunciton and claim for damages, and will ensure the local council including the licencing department are informed.

    Thanks so mich for reply! The parking company called CPM, and they are registered as well. Now I am calling local council and actually still on hold (40 minutes), the lady called Sharon said she is eating in that restaurant and they do ask the parking agency to check this area. I am sure she did not even check the map. When i challenged and asked for the defenitive map she put me on hold and it has been 20 minutes so still waiting for her to give me more information.

    where is this road? if it's a public highway the Indian restaurant could be in a spot of trouble

    You then have porof they have accessed data without reasonable cause, and the restaurant owner is on the hook for a damages claim.

    just to update, I just finished the conversation over the phone ( 55 minutes and over phew) and the first lady put me through to other lady Paula who confirmed that this road is unregistered meaning it does not belong to anyone 😁 and asked me to send the details to them so they could have a word with the restaurant and the parking company . Lets see now :):D

    I would take these idiots to the cleaners, scammers giving out PCN,s on public road what is the world coming to!!!!

    Did she say unregistered or unadopted. ALL land is owned by someone. You can check with the Land Registry or if you can give the location, you can most likely check it online. Bradford, Kent and other places have a "Definitive Map"

    Indeed, unadopted means the council dont look after it
    Unregistered justmeans the land was not bought recently enough for the land registry to have a record of the actual owner.
