    NO I disagree , unlike your CRIMINAL case you quote , the offence would be tried in your LOCAL county court , not the court in the jurisdiction of the offence

    Yes... but the English Company couldn't use POFA as that only applies to relevant land in England and Wales.
  • Thanks for all the posts, I intend to appeal using the template in the NEWBIES section and see if I get any response from the company.
    I am passing the site on Tuesday and will see what signage is there and if it is well lit and clearly sited, not on the incoming roundabout where they have been at other services without any lights.

    And you've got that wrong as well. The court (which should be local) would have to hear the case under Scots Law. Possible but highly, highly unlikely.

    Think of it this way. When there was clamping in England, there was no clamping in Scotland as it was ruled to be extortion. Under your argument, any English company clamping an English driver's car could get away with it scot free so to speak.

    The location sets the law unless specified in the "contract". Theoretically they could put on their signs that English law applies but can't see that working.
